Selfhemployed, can you post a link on the FOCO caregiver ban? All the info I can find is on an MMC ban vote.

have they busted anyone under these rules yet?

Not that i know of, however there was a raid on a commercial grow on monday down here.. Not sure if it was medical or not but they brought in Larimer County SWAT team for god's sake.

Link to the article..

How are they supposed to enforce this law is what i want to know.

where is MMB mentioned in HB1284 or AM20? A caregiver isn't considered a business. Nice job FOCO, making up your own words for shit like MMB. The language will be changed to "more than 5" after a lawsuit. Caregivers aren't MMC's. There's 2 things, caregivers and MMC's. There is no state legal definition for an MMB. Sneaky fucking BS jargon so FOCO can try and manipulate the constitution. All you have to say to FOCO is, "I'm not an MMC, I'm a caregiver" and they'll drop the issue.

Insist that you are a caregiver and you have a constitutional right through AM20 to provide your (5) patients with medication. FOCO can't mess with that, that's as solid as it gets.

Municipalities can't ban or regulate residential caregivers to anything less than what the constitution provides, and that's 5.

And I still have the number for the lawyer if someone is effected by this illegal ordinance. PM me if you want it.

Have your paperwork in order is all I gotta say and get ready to dance...

Am20 does not limit the number of patients as far as I'm aware.

your a lot further along the line than us in the uk,got to be the stiffest cannabis sentencing in europe, they just took a step backwards , its now worse than meth amphet especially the mind bending skunk, i wish you guys good luck, then puppy dog uk might follow suit instead of raising prison sentences,i know ive spent a chunk of my life locked up for drug freedom

Caregivership is still regulated and controlled by the CDPHE. They set it back to 5.

This is for more than 5.

I have a feeling even with "exceptional circumstances" caregivers will be limited to 15 or less patients. 15 is geting borderline MMC but keeps total state plant coverage under 99. This is my opinion but we'll see what happens.

Good advice Tex! Have your paperwork in order and boogie! :fighting0040:

Right. 1284 set that limit, not A20. IMO 1284 doesn't have a leg to stand on in that regard, as A20 protects the caregiver model.

Got to go through my paperwork with a couple of real official guys with guns yesterday, was lovely I tell ya..

The CDPHE could have reset the limit without HB1284. I believe it was just convenient timing. Everything is making sense why they did what they did.

It's all about access to medication. Limit caregivers to 5 in areas that allow MMC's as there is enough access to medication in those areas.

For areas that do not allow MMC's, allow caregivers to fill in the void for medical access but only to a certain extent, basically to the point where a caregiver is bordering MMC territory and starting to get an eye from the fed (<99 plants).

This hasn't been decided yet but I'm pretty sure this is the way it's being set up to function. Caregivers do need a patient cap or we'll end up starting this whole shit show all over again. If you wanna go over 15 patients you need to get am MMC license and have no state protection IMO but we'll see what kind of cap the state sets.

Tex, does the state allow you to carry or conceal (with permit) a firearm if you run an MMC? It would be nice to return the intimidation, but it's BAAAAAAD news if it's the fed.

Five extra years on top of whatever else you get charged with, if the DEA comes knocking, so even if the State says "OK" I'd still leave the guns at home.....

Possesion of a Firearm During the Commision of a Felony, is the charge......

I've heard stories about them using a freaking BB gun with that charge!

Damn TK. Even when ya know yer covered it's still a "Depends" moment, huh?

be safe

Definately not something for the timid..this was at my personal grow/grows, we went to both setups, just a stop in chat, yea right..the real story is crazier than fiction but I can't go into details here.

The showed up during a break in trimming the outdoor material for oil, it was a moment and a half..they where super cool though, Sheriff and the Narcotics task force, walked then through the grows, showed them everything, taught them about oil and candy made with oil, it was a regular love fest...lol..Outdoor blew their mind and material hanging for oil production was way impressive, they loved the bucket systems as well.

There is another permit I am supposed to have in weld county now, to even grow at all according to these guys but honestly they were not real up on all the laws, they had alot of questions and more questions.

Paperwork, Paperwork, paperwork, in a three ring binder ready to go and know where the damn thing is at, if you have two locations then have two copies of it ready to go.

They still have to kick up to the DA but I am sure all is in order..

If you have never walked an officer of the law through your grow rooms, your ain't lived...lol

No CHL for MMC owners, that is pretty much why private security firms work so well..they are liscensed to carry and all the liability lies with them and their parent company.....at least thats lawyers take on it but you don't want guns around just in case your dealing with the feds and not local boys

Tex

unfortunately, you cannot have a ccw and have a red card or purchase a new gun from a store without committing perjury.
