Denver post article today, I wonder who the dispensaries that got the letters were and what their plan of action is? I am sure glad that we passed all 1000 foot restrictions.

Federal prosecutors today announced a crackdown on medical-marijuana dispensaries in Colorado, the most aggressive law-enforcement action yet against the businesses in the state.
The U.S. Attorney's office today sent letters to 23 dispensaries located within 1,000 feet of a school. The dispensaries were told they have 45 days to close or face criminal prosecution and forfeiture of property.
"When the voters of Colorado passed the limited medical marijuana amendment in 2000, they could not have anticipated that their vote would be used to justify large marijuana stores located within blocks of our schools," Colorado U.S. Attorney John Walsh said in a statement announcing the crackdown.
Colorado law specifies that dispensaries must be at least 1,000 feet from schools but also allows local governments to shrink that distance or grandfather in existing dispensaries.
The 1,000-foot buffer is also significant because it triggers enhanced penalties under federal law.
Federal prosecutors and law enforcement agents are working to identify other dispensaries within 1,000 feet of schools.
The U.S. Justice Department has previously said it would not target people operating in compliance with state medical-marijuana law. It then clarified that policy over the summer to state the exemption doesn't apply to dispensaries and their owners.
The letters sent out today are sharply worded and leave little room for confusion.
"The dispensary is operating in violation of federal law, and the Department of Justice has the authority to enforce the federal law where appropriate even when such activities may be permitted under state law," the letter reads. "Persons and entitities who operate or facilitate the operation of such dispensaries are subject to criminal prosecution and civil enforcement actions under federal law."
U.S. attorneys in California had previously sent such letters to dispensaries in that state. But federal prosecutors in Colorado had held off, leading to speculation that Colorado's rigorous medical-marijuana business regulations would keep the federal government at bay.
Colorado has about 700 dispensaries, according to the most recent count of businesses that had an active license application pending with state regulators.

That seems fair there are plenty of spaces away from schools. I would be pissed if my kid smelled weed at school all day. Shit that is common sense I.M.O.

Sounds good to me. Away from schools is a must. If you think its cool well its definetaly not. Colorado can make this work. You guys got this. Dont want it to turn into some cali crazyness. No fun some times out here. Good luck!

Actually it is EXTREMELY hard to find a landlord willing to put a grow or dispensary in their building. Plenty of risk on the part of the landlord. So when the city of Denver only required 500 feet, a lot of places were built, and then grandfathered in. Now comes the FEDS with some new rules and the landlords and the dispensary owners get screwed.

The FEDS flaunt their ability to do whatever the hell they want. The rules are not new. You have to remember that ALL marijuana is illegal on a federal level. The FEDs can arrest you for possession of a joint.

But yeah it's wrong and it sucks that they are spending their efforts on a plant that has killed 0 people. You can't even say that about water.

Yep, pretty stupid, and I am a parent, so I do agree that it's nice to not have my kid exposed, BUT, 500 extra ft isn't much of a difference. Either 500, or 1,000 ... either way, the shop won't be invisible.... just more FED muscle flexing, I'll believe it when they actually raid a shop for just being a shop, so far all the raids on grows or shops have been for EXTRA shit, other than just being a dispensary. I am okay with that, the ones that are following the rules, leave em alone, the ones who are dumb enough to sit there in broad daylight sling blow or whatnot, deserve what they get.

Pros and cons on both sides of this issue, but I feel sorry for the 23 shops that got letters to close of move. Those guys put a lot of planning, time and effort into their business. Now there will be more unemployed and more vacant buildings. Like Bud said, finding a location isn't easy.

The in compliance shops will sacrifice the small number on the hit list and just keep on ticking. That's called team work. This seems like a desperate move by the feds to me.

I have serious questions about "drug free school zones"!!! And.. for that matter..Bars where alcohol is sold and even corner stores where cigs are sold..ALL SHOULD BE AT LEAST 1000 feet from my kids school!! monkey5

Again, the county Sheriff has the legal authority to tell the feds to back off and fuck off. Working at the local levels will remedy this bullshit. Send letters and emails to your local County Sheriff and request a sit-down meeting with the Sheriff. See where he or she stands and if they will not honor and uphold OUR Constitution then vote them the fuck out.........and better yet pick a MMJ friendly candidate to run for the Sheriff position or run for the position yourself. BTW, you need ZERO qualifications to run for Sheriff (at least here in CO).

I plan to run (and win) in the next election in my county.

The 23 shops are just a start. There are plenty more within this distance. You would be naive to think that they will stop at the 23. They are going after a few at a time so they don't band together and fight it. Then they will send a letter to more landlords threatening seizure of their buildings, just like in Cali.

Remember, all they have to do is send a letter and watch these mmcs run. They have complete files on EVERYONE that owns these shops. The State made it easy for them.

Can you cite in the laws in CO where this power is given, kolah? I can find mention of a push in Montana for "Sheriff's first" legislation that would have given such lofty power to the county mounty there, but that measure failed in a big way.

Ditto with the "10th Amendment Nullification" measures.... none of which seem to be LAW anywhere that I can find.

If yer county has such a measure...I'd like to see that as well. I personaly don't believe this to be true...or else we'd have renegade counties all over this State setting up MMJ friendly zones/sales/open-ended grow licenses/etc... which from what i see...just isn't happening.

Good luck bucking the system tho. Consider me good for a $25 donation for your campaign when you make the move and get things going.

anyone really believe 1000 ft from an mmc keeps your kid safer?

I've had kids in HS / graduate is the last few years, and MMCs down the street should be the least of your worries. They are zero feet from party pills made of x and they crush oxy's and snort them to do with whiskey. When my kid told me about the shit the other kids did, pot wasn't even going through my mind. What a false sense of safety this is.
