DENVER (AP) — After a string of pot giveaways and public smoking following the legalization of marijuana in Colorado, Denver Mayor Michael Hancock is trying to crack down on where people can light up.
Under an ordinance introduced Monday, possessing, smoking or giving away marijuana would be illegal in city parks, the downtown pedestrian mall, mountain parks, including Red Rocks amphitheater, as well as cars on public streets.
If you're smoking in your yard but your neighbors can smell the smoke, you could also be found to be in violation and face up to a year in jail and a $999 fine.
The proposal comes less than three months before Denver and a handful of cities prepare to allow pot shops to open under Amendment 64. Passed by voters last fall, it allows adults 21 and older to possess and consume small amounts of pot though public use is banned. It also gives cities the right to ban recreational marijuana sales, as most in the state have done.
In a statement, Hancock said he is following through on a promise to implement the amendment in a responsible way and said the proposal respects the will of the voters while also making public spaces enjoyable for residents, families and tourists.
However, those who helped pass the amendment and the American Civil Liberties Union say it violates Amendment 64.
"It is not a question of whether the proposed ordinance is unconstitutional. Rather, it is a question of how much the city will have to spend on legal bills before the ordinance is overturned," said Brian Vicente, a Denver lawyer who helped lead the Amendment 64 campaign.
ACLU of Colorado legal director Mark Silverstein said the ordinance is unconstitutional, in part because it would make it illegal for people to simply to possess marijuana in certain places, such as the 16th Street Mall, even though Amendment 64 allows it.
In a nod to the reality that pot shops are about to become legal, there's an exception in the law for people who have pot that they just purchased at a shop along the mall.
The proposal could also cause problems at the annual pro-marijuana celebrations in Civic Center Park near the state Capitol each April 20. Even before Amendment 64 passed, police would generally stand by and watch people in the crowd smoking pot on what has become an unofficial pot holiday.
A fact sheet on the proposal says the event would still be allowed to take place but that participants will be expected to follow park rules.
Hancock's spokeswoman, Amber Miller, said the proposal wasn't aimed at the 4/20 rally and that police officers would continue to use their discretion about whether to ticket people for smoking there and elsewhere.
"It really is about protecting our families and our children in these public spaces," she said of the proposal

If Red Rocks doesn't allow smoking it is my understanding (Under 64) that it is the manangments decision to not allow pot on the premises because all property owners in CO now have the right to say if they will allow use on their premises. Sadly, alcohol sales are allowed >everywhere< because it's a huge moneymaker for the venue. Nobody at the venue makes any money off of weed you bring in yourself....and folks will buy less alcohol if they are high as fuck. (most people anyway)

Which brings up another possibility that >someday< they will do exactly what they do with booze and will search you at the gate for bud so you HAVE TO BUY THEIR OVERPRICED VENUE WEED. Just watch. It will happen @ some point. Money rules all. Always. (and remember, pot is now like alcohol...uuuhhhhummm)

The key in the above story about City Park is the word "Public". 64 didn't legalize public use, contrary to what some believe. Not sure WHY folks feel the need to make a parade out of smoking weed..like this 420 stuff or a desire to smoke in the park. (and be seen? Is that what it's all about? WE ARE COOL..SEE US?)

Either way....I fear all of this will force changes in our laws that are NOT good for the entire state....most likely because of these types of gatherings/displays of use in public.
 
They already search ya head to toe at Red Rocks, don't see much changing there.

What i don't understand is the part about being smelled by your neighbors and a possible fine- thats bullshit. Talk about property owners having the right to do as they please....well on my property i better be allowed to do what is legal. Only thing i dislike about it. Everybody just needs to learn to roll with a vape pen.

Not sure why it weirds people out anyway, if you come from a different state smoking in public without being caught is just the standard.
 
We used to bring the beer into red Rocks prior to show before they close park for the show around 4pm.
Would hide under trash can in bathroom.... ice and Heineken's and continue getting hammered all show long.
One time during the encore of the moody Blues with the Colo symphonic orchestra I fell over, threw up, and was carried out. Was lucky that a friend talked them out of hauling me away....Thanks Danny...

Its a stupid law that will be very hard to enforce. And like you guys said, A64 already says no public smoking. I think they just want the harsh penalty to be able to threaten and harass people for pot again. Cops miss that.

The thing is...how are they gonna stop 100,000+ people during one of those rallies? There just isn't enough cops. Better to just disperse the whole crowd with a few gunshots (again).

The thing is that all these laws are still new. People are going to celebrate it. Imagine if beer was just legalized, people would be handing free beer out in parking lots. All of this will pass once its really just a social norm. But there is always a fresh supply of young kids from out of state that will want to celebrate it, can't really blame em. We were all young once. For me it was Amsterdam, and we all got ungodly stoned as soon as we got off the plane. Its still a new thing, a novelty. Give it a few years and it will wear off. However, it may take more than that if we are still the only really legal state (other than Washington, but their weather sucks anyway).

The second quote is fucked, since they just kind of sneak it in that your private property aint so private... but the first quote seemingly implies any marijuana odor will be met with fines/jail time- there are areas all over Denver where 5 square blocks emanate pungent cannabis aroma. I'm curious if the large operations the target or basements... Or both? Does the language of the ordinance makes a distinction between smoked cannabis' aromatic emanations versus the aroma associated with cultivation?

I find it disconcerting that cannabis was decriminalized yet other legislation clearly shows its use is still viewed as criminal. Bored with this reality already- at least when it was completely illegal we knew where we stood and could act accordingly. I'm still gonna behave as if its illegal.

Prove that what you smell is weed... Then if it does pass.. I hate smelling BBQ.. and the Purina Dog food factory... and Commerce City Refinery stinks up Denver all the time.. Oh and Cow Town.. No one likes the smell of cow shit.. Oh cant forget those Hybrid car Farts they stink... Dont run over a skunk you could get an entire street fined. lol.. this shit is more fail than one can imagine.. The Dems better start making friends or come 2014 there wont be any of them left.. So dumb... They Need to Realize more people voted for Legalization of Cannabis than voted for Obama...

lol. Then they need to hit every rancher with a $999 fine. I remember odor being an issue with a big coffee roaster back east somewhere. Even though the smoke coming off the roaster was clean enough, they went after them for the odor coming off the roasted beans in storage, and i think it was the epa. Wouldnt that be great, if your odor is a big enough nuisance you will have to deal with the epa.

You make a good point.....but as we are seeing...the reaction to such gatherings may not ALL be directly related to the gathering and may come back to penalize EVERYONE via more restrictive laws across the board....even those who weren't there smoking and parading. (and ignoring a specific part of the new law that offers them the right to get high in the first place) Think "smoking in your yard is now illegal" for proof.

I understand the exuberance...and the desire to celebrate...but like it or not there are limits to >everything<. Going off your example....Driving is legal...but driving over the posted limit is not. If driving were somehow illegal and then made legal again, would we condone everyone driving around @ 100mph on the side streets to "celebrate" it being legal? Hopefully not.

And how ironic is it that those who "celebrate" the most/wanna be seen celebrating (their long awaited victory? :rolleyes: ) are those who have existed under these oppressive laws the least amount of time? I know a BUNCH of olders who are happy as shit that weed is legal....but they know better than to..... and have no need to run out with a few joints in their pocket to smoke in the park >and be seen< because they realize that the same law that says you can grow and possess also says "we just don't wanna see you doin it in PUBLIC". As some have stated here...wisely...we should treat it all like it is still illegal... because guess what? None of this is truly set-in-stone and all of it can go away as easy as it arrived. All it takes is the public perception that folks have NO RESPECT and are OUT OF CONTROL....and BAM...it goes back to a vote (when the Repubs take it all over)...heavily funded by the "antis"....and again...we ALL get fucked for the behaviors of a few.

EPA has exeptions in place for fracking, but you'll be fined if your pot stinks too much. What a world we live in...
 
I'm thinking shit like this is mostly just to deter the tourism aspect of it. Seems that a big concern for EVERYONE in big government.
 
Wow I wish this was the kinda stuff I had to deal with instead of straight up fear of jail with a you can not grow marijuana and if we catch you growing marijuana were going to take all you own and destroy your family while your in jail but when you get up the bail money feel free to stop on your way home and grab a case of beer and a pack of cancer ......
