It saddens me that the general public doesn’t understand the dangers of rescheduling it to schedule 3. It takes three minutes to look up the schedule rules and consequences for breaking them. Schedule III: Drugs with low to moderate potential for abuse and/or addiction, but less dangerous than Schedule I or II. These drugs can be obtained through prescription, but generally are not available over the counter.

The penalty for selling, delivering, or intending to sell or deliver a Schedule III drug is up to five years of imprisonment and up to a $15,000 fine.
If you are caught with the possession of a schedule III or IV drug, the penalty is up to one year in jail and/or a fine not to exceed $5,000.
So I wasn’t able to find the felony conviction for schedule 3 , but I have read it in the past.
