My massage therapist recently told me that the WP City Council has decided to ban dispensaries and grow stores within the city limits. I just don't understand how all these freakin' politicians can just take away our constitutional rights. Aren't there lawyers looking into this??????

At least it says that the idiots in WP recognize that they cannot regualte private grows as authorized under A20/etc. A LOT of cities/towns/counties, like Denver, are reading 1284 to say that they have power not only over the Centers, but also to limit plant counts/etc for individuals.

Yeah, but what's next? That's just the first step, from what I've seen. Thankfully I am neither growing nor relying on a dispensary, (caregivers are the way to go/grow {LOL}) but still ... I mean I don't get how a city council can vote on something like that and make the decision without even asking we, the people. Of course, that's kind of going on at all levels of gov't these days, regardless of the topic of discussion. LOL

Don't we, the people, have any recourse?????

As long as THAT basic fact/right is ignored and all of this continues to head in the direction of BIG business via legislation (HB1284/etc) that centers on TAXATION rather than patient rights.....

what WILL come next will be a direct attack from the Centers/State against the patients right to grow/have a caregiver. At some point I believe that the DOR/Centers will try to FORCE all sales and growth of medical cannabis in Colorado to be limited to licensed grows and taxed sales. There's just too much $$$$ out there to tap for it to go any other way.

As evidenced by the so-far-unchallenged HB1284......they can easily choose legislation that LIMITS the patient base and their rights under A20...thus...weakening the rights/power step-by-step....and ultimately...nixxing patient rights to grow/caregive altogether.

Mel, that is the psycho who shot those folks in AZ... shot the politicians in AZ... RMCG was trying to show you our only option as far as recourse goes... By the way, N, I peed my pants a little laughing at that...
 
Sorry, then the 'humor' would be lost on you.

He is the AZ shooter that unloaded on the public officials.

Maybe it was a joke, maybe it was a subliminal message to 'try and sentence' the bastards for treasonous acts.
 
OHHHHHHH!!!!! Ok, so I really feel stupid now and, yes, I definitely get it! Feel like that some times fer sure! But if MMJ is our constitutional right, why is that our only option? :( :(

Are they allowed to ban grow stores? How does that work? They aren't even under the jurisdiction of 1284! What if I wanted to start a flower nursery that also sold gardening supplies?
 
RIGHT? There was one store, HydroGrow, right there on the main drag ... 24W in downtown. Noticed a few weeks ago that it was no longer there. But it is now located right beside the only dispensary ... and allegedly they are both outside of city limits. But what if Teller Cty then banned them too?
 
From the article posted, I think they misused 'grow centers' It doesnt sound like they are shutting down hydro stores, just OPCL's and MMC's.

PATIENTS HAD BETTER WAKE UP....AND SOON.

Unfortunately, Mel, there was no clear directive sent out to the local jurisdictions in Colorado by the CDPHE/DOR with a list of what can/cannot be done under 1284. Such interpretation is, unfortunately, left up to folks like the WP town council who have only FEAR to use as their Guidepost.....and any CHALLENGE to such uninformed/BAD decisions are left to be born by patients who DO NOT have the financial means to DEMAND that the law be followed and that their rights are protected.

if you notice, all of the attorneys who once had any interest whatsoever in patient rights are now focused on protecting/defending the "rights" of the Centers, not the rights of patients.... OR they have their sights set on legalization...ignoring the fact that it really doesn't matter (IMO) what laws are on the books if the politicians/leaders are not forced to adhere to the letter of the law and are left to (wrongly) interpret it on their own.

This is a urban myth. I believed it.

Ask yourself, can they make any amendments that curtail your Constitutional right to free speech? Yes, they have (flag burning, libel, etc...)

Where this myth comes from, IMO, is that (most?) elected government officials in Colorado have to swear an oath to the State Constitution. Meaning they have to follow its laws. Therefore an official can NOT take a stand against amendment 20, or they would be breaking their oath of office.


As for the MMC ban issue and lawyer suing.... Let's just say.... they are getting ready to file.... There are also lawsuits getting ready to be filed concerning patients rights...

I think the MMC ban issue will be brought to court rather quickly. Some of the rock-star lawyers are offering a low flat-rate to take these cases...
