thanks for the info. TK, gave him info on your suggested attorney, his current attorney wants 5,000.00 he is going to call your guy as well.....
Again this is an awesome kid, honest, hard working, all teachers love him, just is not right to mess his life up. Even the cop that arrested, state patrol could see that and made several phone calls to see what was up, apologized for cuffing and hauling in. did not even search vehicle.

DA refuses to drop charges. She wants friend to plea to mistimener charge or deferred felony charge, both could affect his college funds and enrollment.
Attorney want $10,000 to take to trial 2 days @ 5 grand a day. Thinks he can get him off, no assurance.
It took 1 1/2 year for samples to get returned from CBI, thus the warrant.
We are looking into do whatever it takes to get him completely off this is so wrong. He is one of the very best kid ever, honest smart hard working, only doe's good things for everybody...
Any ideas, Rob Corry???Maybe another review by another attorney???
 
So my intern/friend who is a senior in college, straight As s wildlife and math major gets pulled over by state patrol for no seat belt. They run a check and turns out they have a warrant for felony cultivation from 2011.
Bailed out for $300.00.
Apparently in 2011 cops came to his house on an alarm or something and found 6 plants, his med card had expired day before.
They left did not take plants. Yesterday arrested, could get kicked out of school for this seems very odd....
Probally too late but find him a doc who will back date the medical paper work .
My advice is drag it out as long as possibly 5 DA and 3 judges later u may get down to nothing. Trial won't happentill the third or fourth time they threaten with it so don't worry.
Took 3.5 yrs going to court to get what I wanted. I'm pretty sure misdemeanor do not affect college loans.

That being said. Tell your friend. .Take them to trial. And claim your rec was current. It wasn't posted when the cops came,only the old one was , it was in your backpack so you could make copies at the library. Do you have proof they ask? No you say. I was never informed by anyone that I was legally obligated to prove I was a mmj patient years after the fact. And clearly the sample that was at a lab 2 years was freaking lost. There are laws protecting you. Let the judge hear this shit. He will fix it.

Marijuana Cultivation, Processing, or Manufacture
It is a crime in Colorado to cultivate or produce more than six marijuana plants for personal use, or for a person to knowingly allow plants to be grown on a property that the person controls. Penalties vary according to the number of plants grown.

Six plants or fewer. Under Amendment 64, if you are older than 21, you may cultivate up to six plants for private personal use. A person who cultivates six or fewer marijuana plants (or knowingly allows such plants to be cultivated on that person’s land) for purposes other than private personal use is guilty of a class one misdemeanor. Penalties include between six and 18 months in jail, a fine between $500 and $5,000, or both. (Co. Rev. Stat. Ann. § 18-18-406(7.5)(a).)

Between seven and 29 plants. This violation is a class five felony. Penalties include between one and three years in prison, a fine between $1,000 and $100,000, or both. (Co. Rev. Stat. Ann. § 18-18-406(7.5)(b).)

30 or more plants; processing or manufacture. Growing more than 30 plants, or conducting marijuana or marijuana concentrate processing operations (or knowingly allowing these activities to occur on one’s land) is a class four felony. Penalties include between two and six years in prison, a fine between $2,000 and $500,000, or both. (Co. Rev. Stat. Ann. § 18-18-406(6).)

Second processing or manufacturing offenses. A second offense is a class three felony, which carries a mandatory minimum prison sentence of four years. The judge may order the prison sentence extended for up to 12 years, and impose a fine of between $3,000 and $750,000. (Co. Rev. Stat. Ann. § 18-18-406(6).)
Are such stringent growing restrictions and penalties to dissuade competition with licensed and taxed producers?

What a waste of county taxpayers money ..... The lab had the shit for a year and a half? They probably need to be looked at for their chain of custody procedures, how many people handled it and moved it around?
Now this "IS" a crying shame ... Wishing that kid all the best.

Pretty sure these laws have been on the books since well before med/rec arrived.

But yeah.... it's now tax dollars out of the State's pocket and profit out of the chosen few's pocket if you speed. Thing is, other than the med folks who are on a list/who have stated in writing that they are growing more than 6...who's ever gonna know...especially if you aren't slinging pounds around/etc.??

so here what happened in the beginning.
CO2 alarm rings, when friend is away. Dumb ass roommate gal call 911 fire dept shows up cops come find 6 plants and 1 sprout.
Friend show up tells him has red card, 45 plant rec.
however card is at moms house 200 miles away.
Cops take samples, tell him to check in when he gets his paperwork.
Kid gets paperwork calls to inform, was told they will get back to him if needed.
Kid waits hears nothing goes on.
Gets stopped found warrant busted.
So they sent samples in and it took around a year for results .. After test result they issued warrant, felony cultivation which just doe's not make any sense at all.
Last conference with attorney and DA., Da would cut off attornies attempts of rebuttal sticking to her guns. She is not the elected attorney so were hoping for him to look at this mess and drop charges.
 
I know its going to be expensive but I would do the dance in court..sucks it was pre-64 but even so he was not doing anything aggregous so he should be fine, I still kind of shocked the DA is persuing it like they are...Correy, Edson, Sederberg, or Vincente would be up on my list of guys to talk to

That is all just crazy man but it is a reality check and by law can happen to any of us I guess. It doesn't hurt to get reminded.
I try not to give legal advice on weed but in Pueblo they wouldn't have even messed with him a bit. Here unless they think its got meat for a serious federal problem it is considered a waste of tax dollars to police at all. I had cops in my crops several times no ones even looked at my card even before 64 now fuck half Pueblos eastside had entire back yards full and the county was a zoo cuz they couldn't afford copters along drainages like they always have until last few seasons. A lil bird says no more copters unless ya are snitched for something bad and they are confirmin a big warrant. Cops here have another not so nice part the green rush to worry about. A massive amount a meth coke and heroin from mexico coming in to replace THIER pot market our green rush crushed already. I have a good buddy from Sinaloa and he says lifetime pot farmers in their sixties are all learning poppy cultivation.


Sucks but all ya can do is pay a lawyer to drag things out forever. He may have to buck it up and go to trial. No way they can assembly a jury to convict him. Just sucks they are seriously wanting to go after a young man who is obviously trying life like that. Most growers and even business I know is not in perfect compliance even not even close when they think they are. I don't even try or have a red card anymore just don't feel rebellious enough to me and I cant count my plants everyday all nervous lmao.

Called Correy's office. Spoke with an associate. Was pleasantly surprised she took time to hear out the case. She will look at the discovery for no charge review and get back to us...She thinks it's pretty strange for those few plants they are messing with him...
Sure would be nice to sick Rob on them and get this dismissed as he has the reputation and knowledge and would be way better than his current attorney...
Again this kid harmed no one and has done nothing wrong and should not suffer any more BS than he has already....
she also said it's not uncommon to charge after the fact after results come from CBI.......
Hoping they can help. Surely he has gotten others off on way more serious charges so this could be fun for him to slam dunk and let this kid continue to good for self and mankind which is his intention to help save the environment.
Whatever it takes will cover, a good investment for his future.....

Ya man try to get Robs people involved. just his name associated with a MJ cultivation case for 7 damn plants sounds fuckin ridiculous to me and he will give that cunt hanging DA involved a good fillabusting to fuck with. No fucking way they'll pursue it any longer cuz dude will make a mockery of them from the ground up over it. I mean WTF every 5th house in Pueblo has more plants than that.
And it is seriously threatening his future so if paying Rob a chunk to send a few nasty communications is what it takes its money well spent. Unless there is way more to it we all don't know there isn't enough substance for anything to go far anyways so I doubt it costs a lot for a lawyers time. The more of a complicated clusterfuck the more it cost ya to have a lawyer sort it out. I've paid lawyers a couple three times now and its expensive but always worth it in the end. Teflon Don says" if you cant convict you must aquit." That's is exactly what Rob will do to make it flat out impossible for a conviction. It is hard as fuck to assemble a jury in colo with 10 marijuana haters now too bro damn hard 3/10 or more smoke regular and more than half occasionally or wish thy could id bet.

I guarantee ya even if the kid lives a good life to our ages he wont be able to count the folks he meets like you on one hand when he gets here. I get frustrated, last night we had a sick kid goat did my best, to comfort her, this morning she was dead such is life on the farm...
Carlos Santana once told us at a concert do good things for others, no matter how big or small it gets returned in ways you may never know....Saying hello to strangers, be nice to old folk, don't be afraid it's way cool even if they do not get it. Even the littlest of things add up.
This kid is so awesome. Just looking at him we can see bright light and a glimmer in his eyes, looks like harry Potter...
Him and GF love to get baked and talk science and nature. She spent 6 months here on farm and told us she learned so much about life that could not be taught in school even though she is straight A student and if she learned some thing from me wow that's awesome, a good self pat on back is better than a kick in the ass......
We have no kids. Our blood relatives are too involved with other things to even return phone calls so we planning on leaving our estate to him so he can live here and do good things for mankind and hopefully he and his GF will marry and enjoy this paradise after were gone.
He is sending discovery package to correys office for free review....

End result, he stuck with his attorney and the made a deal. mistimener.
Dunno if this is a good deal or not, will help him pay most of his fine, he already has 20 hours of service done....
$2,000.00 fine 1 year supervised probation including drug tests.
40 hours community service. If he pays fine and completes community service probation is over. no more pee teats, should be done in 2 weeks.... In 5 years if he stays out of trouble expunged from record.
 
At least its not a felony charge...seems excessive still but sometimes ya just have to stand a take it to keep from getting something that follows you the rest of your life on your record. As soon as it is dismissed for completion of the terms of probation you can start the process to have it sealed...expunged is for juvenile charges, sealed is for adult..still takes 60-90 days to get seled and government agencies can still see it but a general background check won't pop
