If you are worried about the 1oz limit that people are talking about, may I guide you to section 3(B) of the initiative.

3. Personal Use of Marijuana. NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE UNDER COLORADO LAW OR THE LAW OF ANY LOCALITY WITHIN COLORADO OR BE A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR PERSONS TWENTY-ONE YEARS OF AGE OR OLDER:
(B) POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY, AND IS NOT MADE AVAILABLE FOR SALE.

Clearly, if you grow your own cannabis you will be able to have as much in your house as you can get off of 3 plants at a time.

What, pray tell, is the legal definition of this "competitive application process".

Every heard of a city called Oakland?
100K+ to get your foot in the door on that one, before the Feds shut it down. That was a 'competitive application", with FOUR slots.

DoobyScoo - I lived in Oakland for many years. I do find it interesting that there are only 4 dispensaries there, now, and for that matter only 4 in Berkeley. It was great back in the early 2000's when they were peaking in numbers. However, as I am assuming you know, the City decided to limit the number from I believe 11, or 7, to four. Some of the requirements that Oakland had was spacing between dispensaries - I remember this alone shutting 4 dispensaries down, in Downtown Oakland. However, the remaining 4 dispensaries are up and running and have not been shut down by the Feds, as you seem to suggest.

More recently, the City of Oakland wanted to consolidate all the growing in the City into 1 or 2 large warehouses. Many folks protested this because it would have prevented a lot of them from selling their crops to the 4 dispensaries in Oakland. However, in the end, the fear of Federal prosecution appears to be what killed this idea.

In answer to your competitive application process definition question - I'm not a lawyer - but I did forward the question to one of the 3 lawyers at SensiCO. When I hear back from him, I will pass it along to you.
 
The 4 despensaries in Oakland, the Harborside monster being one, went to the city of Oakland and let them create a new tax code specifically for them and convinced the city that they would be the only ones that would even play by those rules and 4 was about the max the city could track effectively anyways...they bought it and ran all the others out of town and put and expansion moretoreum in place, no new players...

Those 4 despensaries posted revenue in the 20+ million range last year from what I read.

thats why they dont want caregivers to caregive or anybody else growin to make money without taxin. My patients get meds free, I got great patients. They dont resell, party with their meds, brag to others about the quality or our situation, are older and responsible users, now, now, nothing wrong with you young whippersnappers, but listen to us old folks, posibly, like I did youll learn something from our mistakes and sucesses . Extra meds are distributed to others, $200.00 a zip, or come work on farm 1 gram an hour plus all the veggies, milk etc.to a very few selected friends who dont resell , to cover my grow costs and put some coin in my purse. Nobody here is getting rich from mj., I am not a drug dealer
Greed by some has ruined it for those who are the true seekers of light.
I love to farm and produce my own high quality nutrient dense food, and top shelf mj., so leave me alone unless I get greedy and go overboard. Whats happening to freedom in this country?? Same is going on with small scale farming, cant sell raw milk, they passed a food safety bill that allows the USDA to shut down anybody for safety reasons without any proof of a problem...So much for the land of the free. Consider this. how can we say were a free country when not long ago we had slaves? In a way were all still slaves to the system
Why cant they just leave the good guys alone and go after the real crooks? Because they are the crooks!!! Got me going this morning, the coffes strong and the ganja good!!

No its called Richard Lee and Harborside, they wanted a market, paid for it and got it.

I still think this bill is in the wrong direction for adult interest, just work on removing criminal penalties/lowest prioritizing- not implementing a bunch of more crap. Like i said, work on solidifying the rights of patients (which are still up in the air and getting regulated more daily obviously) before throwing in another group of folks to get regulated. Look at SkyHigh, had to drop $4k to solidify his constitutional rights as a patient, none of these supposed patient rights cases were pushed, and folks are concerned about trying to work on a legalization bill? Lets fix what was fucked up for us first.

Doesn't matter if you are selling meds or Mary Kay cosmetics. If you run a business you are expected to pay taxes aren't you? Or does marijuana grant some sort of exception to taxes ?

From what I understand, four BIG disps in Oaktown.
Four slots on the -mega grows-.
Many local CGs more worried about the ensuing creation of a local authority, and an influx/dumping of weed on the street, than not being able to vend to the Dispensary.

And I can't wait to hear the 'lawyer speak' on that 'Competetive application process'.
That is exactly what was happening in Oakland.

You forgot IGrow (now WeGrow, was in on the bidding too.)

I know I said 100+K, but more like the 250+ range, I just couldn't find the old news article before I got sidetracked.

Any time Regs are introduced that required additional capital investment, that becomes an economic barrier to entry.
Thus, not free trade.

Good point, thats exactly what I mean, but dont you think we pay enough taxes allready and for what???? Endless wars, Govt waste

@Dooby - Here is what I have. I don't think it is as deep as you would have liked.
The initiative does not create or mandate a competitive application, and most likely no competitive application process will actually be used. All the initiative does is state that if there is a competitive application process preference will be given to experienced operators, as opposed to the person who camped out overnight to be the first person to file their application.


I'd personally chime in and say that I see no problem with muncipalites limiting the number of MMCs. Muncipalites will NOT create just a one store city because this would create a monopoly, and everyone knows those are not ideal.

@Grit : I'll reply to you later. You raise a lot of good points that need discussed, but I'm just to busy right now to give you an appropriate reply.

We have just witnessed what our elected officials think is 'fair'. Been watching for about two years now.

Really, a Council will almost never create a monopoly. I'm 97% they legally can not.

And true, let's only hope that we can incorporate some aspects of the most diverse State, and Cities (Oakland) in America into Colorado.

What would you suggest? I, personally, think having a system were CO-OP's can sell to MMC is what we should return to, or just follow CA's example on how they supply the MMCs.

Why should a Vote of the People, be opening up avenues for corruption by Elected/Appointed Officials?

A wall is dismantled brick by brick, but we shouldn't leave those bricks around with mortar for more walls to be erected.
