The Nevada Supreme Court has rejected a California woman’s appeal on a case in which she said Nevada’s marijuana law interferes with her right to travel. Shira Monet Garfinkel is a legal medical marijuana user in California, but the Nevada High Court said CA law doesn’t allow her to drive with marijuana in her system; they also told her driving is a privilege, not a right.
The woman was “convicted of driving with a marijuana metabolite content greater than five nanograms per milliliter in her blood,” when she was pulled over by Nevada police. I have to admit, I have no idea what that means, and I doubt it gives any kind of representation of how “stoned” someone is.
Law are always going to vary from state to state, but if a state is going to set limits on using cannabis and driving, there has to be a reliable way to measure someone’s “impairment.” But there is no way a blood test can tell how high someone is. There are so many variables when it comes to quality and quantity of marijuana consumed. Different strains have different levels of THC and therefore different effects. These effects can last varying lengths of time. I could go on and on.
Marijuana is not alcohol, and there is no reason to treat them the same when it comes to driving."

I am not sure if this case was one of the recent where the new Draegor 5000 saliva test was used or not. IMO there are serious issues with that testing unit and its companies performance as well as ethics. I am investigating and will be providing more info for you soon. DD
 
Lol, that's some BS. Who's to say she doesn't have a great tolerance from smoking that CA bud, Nevada buds prob aren't as good.
 
Wow... I guess I'd better plan not to visit Reno, Carson City or head down 395 from home, eh? I have a feeling my own metabolite levels are astronomical compared to that number, cuz ah smoak awl dai lahng.

Good thing I don't live in Tahoe anymore, either. What am I laughing for? this isn't very funny. How much time is this woman gonna have to do? Any information about what prompted the testing in the first place? I don't get pulled over very often, when I am I'm usually let go with a warning, but still, this gives me pause.
 
Man u think thats bad the county that I live in if the police stop u and u tell them you have a medical card for that 1/4 of personal in your pocket they will tell u to get out do a field sobriety test cuff u drag u to the hospital and take your blood. It happend to me charged with a dui. It happend to me no possesion charges but a dui in Mi aint no joke. Oh yeah and that blood test goes back 8-12hrs. You could smoke at 10am and that shit will show on a blood test at 10pm your still under the influence. 5g for a lawyer got the charges dropped.
 
Dannnng! That is just horrible and a stupid law. I feel bad for the poor lady, that really really sucks. Mittenmedgrow- that is a nightmare come true. Glad you got out of it but sucks you had to pay 5 Gs for a lawyer. The justice system is nothing more than organized mafia and extortion..money talks, then you can walk.
 
Mitten thanks for your info..I am hearing more and more of, if you come out and tell them you're a patient it leads to disaster, the test etc. Doesn't seam right does it? If you have to take narcotics, like I have to for pain, they look at the script bottle and wave good by. DD
