Im not sure how you would enforce no out of state ownership/investment or if its even legal?Can you imagine if cali said you have to be a resident to profit/own a gas station?Or new york said no out of state pizzeria owners?sounds like a lawsuit waiting to happen.If this applied to other businesses in the state can you imagine the carnage to the economy in colorado?You cannot dictate who can make a profit in your state based on their residency or every foreign corporation or entity in colorado would not be allowed to make a profit.If they did this and it was allowed to stand it would set a precedent that would start the dominos falling in other businesses also,Im just not sure how they plan on this working out,interesting to watch for sure.

They just won't leave the vertical integration thing alone, will they!?! How does it effect cops enforcing the law whether a dispensary produces their own product or not. Sounds like someone from the dispensary lobby got someone on the police lobby to agree with them ($$$). Or some dispensary owner has a cousin/brother/business partner that is a Sheriff. Vertical integration doesn't work and the current medical system is completely corrupt and unenforcable, even cops, politicians, and the MMED have admitted it. Seed-to-sale tracking is not enforced currently and only exists on paper. And why this issue over all others to "keep the kids safe". Sounds like a pile of horse shit to me. If I was a cop, vertical integration would be the least of my concern.

FWIW....unless it has been changed :rolleyes: there were/are residency requirements for the MMJ program and licensing under 1284 as well.... and the rec law was passed with a loose understanding that a lot of this "recreational" model is/will be modeled after that commercial program. (failed or not:finger:) It also appears they are looking into a one year (that will go into 2 or 3, IMO) "moratorium" on commercial licenses beyond the currently licensed MMJ folks. This would give out of state folks time to establish residency here and take their place in line to play. (LOL) As I say....this "moratorium" approach was also taken under 1284.....and has pretty much stalled >anyone else< from getting a license here...even our own citizens....which truly...are who these laws are passed for....or should be. I hear what you are saying....but the laws and the extensive/intrusive 30 page application to license...if they license ANYONE outside the MMJ realm.... will >weed< out a lot of chances that someone will slip through. (10 years of personal info/tax records/credit reports/bank records/residency requirement/proof/proof/proof)

Either way....the State needs to set something down >soon< so the FEDS can put their foot on it and squash the fuck out of it and the folks who live here can get back to takin care of business.... much like you folks living there in Cali get to take care of your business. Of course, if you want to let us into your game.... which is far better than what we have here..... many regular guy types would be all over letting you have a crack here :D

Sky,As far as im concerned anybody who wants to be in the game in cali is welcome,lol,I choose to play my own game,i like it better than theirs;),so they can say or do what they want and ill do the same as ive always done..Id bet the guys who already have their foot in the door in colorado are just throwing up roadblocks every way they can to buy time and try and get a leg up on the competition coming to town and fuck over the little guy(you!),Their REAL competition.You KNOW they are lobbying law enforcement and elected officials hard to keep them on their side.I have faith in the little guy to overgrow all the moneygrubbers anyways,they cant compete with the states hand in their pockets and overhead,they could sell oz's for five hundred and a little guy can off them for 2 and still be making as much or more then if he vended/sold to the dispensary.Wait til the feds step in like they do here and send a few folks away for 10 years then you'll see the scared money run,its not so fun to own a dispensary and be a cannaking when you are actively being targeted and pursued federally,Shit they take the dispensaries out a whole town at a time here,lol.

And I think Fish is will be right in the end, with a bill titled as treating marijuana like alcohol, some big biz will come in and sue because they can't play and can with alcohol. Def special circumstance but doubt that will circumvent the actual legal process...

64 has nothing to do with patient rights under A20. In fact, if yer med you can have yer med count and your legal count under 64 as well.... at least that is the way >I< read it/will operate.

I have not read tex's links yet yet but keep in mind that any corporation is considered to be its own ''Person'' for lack of a better word,it has its own social security (EIN) number and the same rights as a person even though its an entity.So even though i live in cali i could start a colorado corporation and "It" would be considered a Resident of the state,also its not exactly easy to pierce the 'corporate veil' so to speak so its really hard to prosecute a corporation,you can do it monetary harm but you cant send it to jail and everyone who works for it are considered ''employees'' even if you are a majority stockholder,usually employees of a corporation are pretty hard to prosecute,not impossible but much harder.This is why any business of any size is incorporated,all the stockholders are basically held harmless and not liable for what the company does.I beleive Non-Profits are a type of corporation also known as a 501C.
This is how the crooked drug companies can kill millions with their poison but no one goes to jail ever,only monetary damages and who cares if you have to pay 50 million damages when you just made 500 million?

Just a couple thoughts after reading tex's links,
25% tax(15 excise/10 sales)+overhead of cost of doing biz will give the smaller "cash cropper" for lack of a better word a nice little advantage.
Also if they do it to weed you could make the argument that alcohol and cigarettes should also have these inflated sin taxes,they fuck up alot more people/kids than weed so they should be scared and all the states are looking for more revenue right now,coors and philip morris watch out!
I have no idea how a state can declare that only legal residents of that state can be involved in certain businesses,lawsuits will come out of that and colorado will probably lose.
High times will probably sue the state most likely for making a magazine about something that is now legal be treated like pornography.
DUID scares me!Fucked up shit but you know it was coming.
64 thousand dollar question is what will the feds do?They cant keep kicking down doors in other states daily and let colorado do whatever they want so their either gonna have to back off everyone else or attack colorado and make an example out of them,theres no middle ground for them to stand on.
Its not gonna be perfect at first but i think colorado did a good job and things will morph as time goes by,you gotta start somewhere.
