Police Forced to Return Over 60 Pounds of Marijuana to California Dispensaries


Police in Vallejo, California have returned over $200,000 worth of marijuana, including 60 pounds of dried bud, and boxes full of marijuana-infused food products, to two dispensaries in the city after a judge ruled that they were illegally raided. The police also returned hundreds of now-dead plants: Scott Candrell, an attorney for one of the dispensaries, stated that they would seek damages in court for anything that was lost or destroyed in the raid.
The situation started last year, when in February, Vallejo police raided around six dispensaries, charging them with marijuana distribution. Given that all six of these organizations were legally following state law, the cases were dropped.

Since these raids, which cost the city hundreds of thousands of dollars, Vallejo Police Department has cut their staff from roughly 150, down to 90, which has resulted in an increase in crime.
Since the raids, the number of dispensaries in the city has increased, prompting the city council, without logic, to place a moratorium this month on any new medical marijuana business.
Did we mention that this was the same city that was so unstable with their finances, that they were forced to file bankruptcy?

One thing I see in CA is that there were no pre-emptive provisions for localities banning cannashops. Usually the localities call in the Feds and its game over. In Vallejo they made the mistake of not calling in the Feds, and the ate their own shit because of it. Had they brought in the Feds, no one in Vallejo would be getting their weed back.

Wash. judge tells police to return marijuana

TACOMA, Wash. (AP) — Police in Tacoma could soon be in real trouble over pot.
The department could be found in contempt if they continue to refuse to return a small amount ofmarijuana seized from a man after a traffic stop. Municipal Court Judge Jack Emery repeated an order to police Thursday to return the drug to Joseph L. Robertson within seven days or they could be found in contempt.
"Appeal or comply," Emery told assistant city attorney John Walker. "Or next week, show up, and I would advise you to bring counsel."
The judge first ordered police to return the drug on Feb. 28, but they have refused, The News Tribune reported Friday ( ).
It was seized in May of last year when an officer pulled over the Tacoma man for speeding. He was cited for driving without a license and misdemeanor marijuana possession. Prosecutors dismissed the drug charge in December, after state voters decided to legalize small amounts of the drug.
Robertson then asked for his pot back, and provided proof of medical marijuana authorization. The city refused, which led to Emery's Feb. 28 order. If the matter is not settled by the May 2 hearing, it could go to higher courts.
The pot is now in the possession of the Pierce County sheriff's department, which operates the property room for seized evidence. Deputies won't give it to Robertson.
"It's Tacoma's case," said sheriff's spokesman Ed Troyer. "If they want it, they can come and get it."
Although the judge said he thinks "there's contemptuous behavior here," Emery added that the case was "a quagmire," due to the conflicting provisions of state and federal law.

Because they didnt want to share the spoils.
They are money hungry being a bankrupt city , having theior budget slashed nearly in half and the social pressures of a rising crime rate. The meth and coke isnt as easy a target...
So go bust some pot shops like everyone else and keep it to yourself. Might see some more of this sword fighting over prospectable resources by less intelligent or ignorant localities.

We had a similar situation here in Colorado (the Bob Crouse case). The oink-fuckers busted him and took all his weed and plants. He won his case and asked for his stuff back. The pigs kept avoiding the issue but finally gave it back. It was all moldy and the plants were half dead, lol.

So now Bob filed for a million dollar lawsuit.

Once cases like Bob's hit the common people they will quickly see what waste of tax dollars it is to attempt to prosecute MJ cases. Power of the jury at work. Education.
