woman prison hands Schwarzenegger Decriminalizes Marijuana In CaliforniaYesterday, outgoing California Governor Arnold Schwarzenegger signed Senate Bill 1449 — which reduces adult marijuana possession charges from a criminal misdemeanor to a civil infraction. NORML would like to thank the 2,500+ of you who took the time to write the Governor over the past week via NORML’s ‘Take Action Center’, and the many more who called the Governor’s office directly in support of this historic measure.

Senate Bill 1449 amends the California Health and Safety Code so that the adult possession of up to 28.5 grams of marijuana is classified as an infraction, punishable by no more than a $100 fine — no court appearance, no court costs, and no criminal record.

Passage of this bill will save the state millions of dollars in court costs by keeping minor marijuana offenders out of court. The number of misdemeanor pot arrests has surged in recent years, reaching 61,388 in 2008.

The new law, which takes effect on Jan 1, 2011, will have an effect even if Californians vote to legalize marijuana by passing Prop 19. Proposition 19 leaves misdemeanor possession penalties in place for public use and smoking in the presence of children; under SB 1449, these offenses would be simple infractions.

“Gov. Schwarzenegger deserves credit for sparing the state’s taxpayers the cost of prosecuting minor pot offenders,” said California NORML director Dale Gieringer, “Californians increasingly recognize that the war on marijuana is a waste of law enforcement resources.”

maybe this is preemptive to give just enough so the citizens feel legalization is not necessary?

It's good to see real decriminalization happen. Here's hoping the next victory doesn't take another 35 years. Of course, even if it does, we still have plenty of fight left in us.

watch out there probly gonna copy the mass plan in which every single town and city can introduce there own fines on top of the states initial fees for instance 5 towns from me the town made an ammendment that said the police can not pursue any marijuana any-thing simple possesion-commercial grow ops or in my town on top of the 100 dollar fine/ticket the town itself issues a fine of 300 dollars so if you get hit you lose your ounce or under and get hit with a $400 fine/ticket
what i would like to know his what is the amount decriminalized to an ounce 2,3,4 what what the limit before you get criminal charges

Let's not get ahead of ourselves. The schwarz has fucked with us too much for something like this to redeem him. The asshole directly compromised our 2nd amendment rights by taking .50 caliber rifles off the market and now we cannot mail order ammunition as of last july.

This is pretty cool though. . . I am thinking this is a bone they threw to the people because prop. 19 is not going to pass and they know it.

ya but its not really a bone its a catch 22 lets say you pay 300 for a z and then get hit with it lets say thats a state fine of 100 so far your up to $400 and just wait you will see the local governments [the cities and towns]will have there coffers out adding there own little fine on to the already $400 that your paying all it is is a way for the powers that be to demoralize certain members of the community at large by way of profiteering off a law thats supposed to be there to help said community members it will happen in california as its happened in massachusetts
