Texas lawmakers consider telling U.S. gov't to 'cease and desist'

Note to Washington, D.C.: Texas is a sovereign state.

After Gov. Rick Perry's recent comments about some Texans talking secession from the union made national news, legislators are considering issuing a "cease and desist" order to the federal government.

"This state prefers, to the greatest extent possible, to control our own destiny,"said Rep. Vicki Truitt, R-Keller, one of several members co-sponsoring the measure. "We prefer that federal government limit the amount of federal mandates it forces uponthe people of Texas."

House Concurrent Resolution 50, which claims sovereignty for Texas under the U.S. Constitution's 10th Amendment, was one of several proposals to go before the House State Affairs Committee late Tuesday.

Rep. Brandon Creighton, R-Conroe, filed the bill, saying that more than a dozen states have proposed similar efforts amid concern that the federal government may be overstepping its boundaries.

"From restrictions on gun and ammunition sales, to freedom-of-choice issues, to the Real ID Act, the federal government is passing laws that limit a state's ability to govern itself," Creighton has said. "Texas simply wants to send the message that we want to govern ourselves and decide for ourselves how our money is to be spent."

Under this resolution, the 81st Legislature "hereby claim sovereignty under the Tenth Amendment to the Constitution of the United States."

"This serve as notice and demand to the federal government ... to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers."

Rep. Mark Shelton, R-Fort Worth, also signed on as a co-sponsor.
"Texans should have the right for their representatives in Austin to decide what is best for Texas," Shelton said.Perry -- who stirred a firestorm last week with secession talk -- said he supports this bill, especially since the federal government "has become oppressive in its size, its intrusion into the lives of our citizens, and its interference with the affairs of our state." "I believe that returning to the letter and spirit of the U.S. Constitution and its essential 10th Amendment will free our state from undue regulations, and ultimately strengthen our union."
Rep. Lon Burnam, D-Fort Worth, said that he initially considered serving as a co-sponsor as well but that he changed his mind because of Perry.

"The concept has been corrupted by gubernatorial politics," he said.

Yeah, if us Texans want we can become our own nation. Ain't that a scary thought? A free nation run by rednecks, we would go Orwell's 1984 in a matter of weeks. Thankfully like most Texans when we speak of this, Perry was just kidding I'm sure. Texas would never legalize Cannabis on its own. But telling the feds to butt out is a good start I guess, now all you other states need to follow suit and stand up to the man. I'm looking at you California.

I'd like to think it was about freedom of choice, but this is texas...there will be NO freedom of choice, no abortion, no mj, mmj, same sex marriage, no racial equality, no freedom period. And if texas does not get fed funds, then texans will be paying out for the wall between mexico and texas project as well as all the other formerly fed funded projects like the war on drugs. Texas is and always will be pro god, guns, guts, oil, john wayne and $$. And make no mistake...this ain't a joke....this is real, and very scary.

It sounds good and I know that there are I think 20 other states doing the same thing. But as long as Perry is governor things aren't going to get better in Texas. There is video online of Perry attending the last Bilderberg meeting. That alone should throw up some red flags.

Well if he's so concenred aboput the constitution he should also force the federal Government to collect taxes accordingly. That ,means by apportionment and not by theft through your paychecks.

I live in TX, and although this is a very conservative state, like most of America there is change in the air. I think we can change. Slowly like anywhere else in the world, the old die and the young change everything.
If you think there is nothing but conservative cowboys running around with six-shooters in Texas, you need to go to Downtown Austin on a Sat night. Counter Culture to the max yo.

I used to think change was in the air too. Obama was a big disappointment so far, and now perry wants to do this, and I really am starting to believe we're gonna get "chains " we nedd alright.

Where I am we got counter culture to SO....and I ain't dissin 'em ok? but how many of them vote? are registered to vote? and I knw they're good people, but they ain't the ones in the capitol makin the laws.

Here's what I envision...call me a conspiracy theorist whatever, I ain't care.

The political winds here have blown a certain direction for a LONG time. Now we have a liberal dem in the white house, and texas can see itself being forced to accept some policies it is very much against. Pre-emptive strike....secede.......and perry's a nut enought o do it too. He served his internship under the gr8 puppet himself, W Bush, when he was his lt gov. Is the puppetmaster ( cheney) in texas too? think about it mang.......

When MMJ was on the ballot here in 2005, Bush called Perry and told him to get it off the ballot or lose all fed funding...perry was happy to oblige, and tabled the mmj bill, effectively killing it. A Bill get's tabled, it means it's too hot to handle, nobody wants to touch it without further "study" paid for by taxpayer $$. Now, all of a sudden, Perry says no to fed bailout $$, and is contemplating forgoing it completely?

All of this may be political posturing, designed to make the supreme court make a decision on the case and decide whether or not we as states are indeed getting too much fed intervention...but if texas don't like that decision, what next? Texas maintains its right to sovereign status and it's right to reject federal laws and mandates?

And scarier still, Texas is not the only state considering this for one reason or another. My fear is that Texas will go extreme conservative, which it already is.

anyway, peace out, you bring a lighter and I'll bring the loaded bowl bro.........:passingjoint:

I was just trying to make the point that the world is very much the same the world over. No matter what most people think. Just cause we are in TX does not mean we are all conservative hate mongers. We can change just like everyone else.

I don't think we need worry about Texas going rouge and becoming a nation. No one here would stand for it. I don't think any state thinks leaving America is a good idea, its madness.

And please don't get me wrong, Bush serves the devil and Perry is his puppet I know.
But I just don't think Perry meant it when he talked about leaving the U.S. Texans like to joke about that, and I just can't imagine anyone seriously going through with it. Although I have not seen the footage of him saying it, I just cant believe he meant it.

But no doubt we need to be careful and watch these politicians at all times. Read Orwells 1984, scary stuff that.

Sometimes I think a zombie apocalypse would probably be the best way to sort out the world........but what can ya do.....

.. Actually Mexico gained independance in 1821 from the Spanish empire and was given Texas by the Spanish who had conquered it from the Native American Tribes.

In 1836 Texas was given to the Colonized States in the Treaty of Guadalupe Hidalgo by the Mexican Goverment... People are getting really rude in this thread and I hope logic comes through and starts dropping the hammer.. Dumb racist comments
