Urgent Petition for the Department of Health

Hey guys I am a bit behind getting the petition together, I am very sorry, been busy with work, been under the weather, and had some problems in my flower room.

Here are some points from some of the members of the various boards, I want to finish the rough draft today, and mail out the petition either starting this evening, or tom.



If anyone has time to add to, spell check, or anything else I would greatly appreciate it, grammatical English is one of my weakest points.

I think the DOH should increase how much an idividual with a personal production license can produce, from 6 ounce to a pound, if someone grows outdoors they would only legally be able to grow 6 ounce to last them the whole year.

I think giving the secretary of DOH sole discretion to determine the number of medical cannabis producer licenses that will be issued and which nonprofits will be licensed, with no right to appeal his decision, is a terrible idea and is setting up a dictatorial system.

I believe an individual whose initial application into the medical cannabis program, who has been denied should be entitled to an adjudicatory hearing to contest the denial. I also believe that any Non profit producer applicantions received after October 1st 2010 should be entitled to one review.

I do not believe the Medical Advisory Board should be granted the authority to remove qualifying conditions from the list of debilitating medical conditions that qualify for the medical use of cannabis, or the addition of particular eligibility criteria for persons applying under those conditions.


I believe the average surplus for the licensed providers should be provided to the patients. As these producers are non profit I feel these financial records should be public

The DOH should set salary limitation on the licensed providers in order to effectively lower the cost of mediciation for all .

Cannabis should not cost between 5,000.00$- 6,000.00$ a pound to produce, taking into considerations all expenses cannabis can easily be sold for a 1/3 of what it is currently be sold for. The fair Market price for cannabis is inflated due to its prohibition. Prohibition has caused inflated black maket prices on cannabis. If tomatoes were made illegal tomorrow, next year the cost of tomatoes would be several thousand dollars a pound. this is a inflated black market price.

As it is now the producers are charging more than drug dealers on the street.


I feel the term non profit to be misleading, directors of non profits are non limited on their financial compensations.

In some non profits you have directors being paid 600,000.00$ a year.
As in many cases, non-profit is a misleading term. In addition to addressing the financial and covetous deportment of the DOH at this hearing, we should be debating salary limitations on the providers in order to effectively lower the cost of medication for ALL patients.

But we must have significantly lower prices for ALL patients. Instead we have the Department of Health and licensed providers fighting over who is going to get what part of the patients money.

I can’t afford my medication.
If I were to buy Medical Cannabis through the approved dispensaries I would not be able to pay my rent or feed myself. The fact is, one ounce of Medical Marijuana purchased through the approved provider’s costs more than one month’s rent for most patients

I would like to believe that between the Department of Health and the licensed providers there are some human beings who are involved in this program for altruistic reasons. But I will state unequivocally, that both entities primary interest is to make money off the backs of patients in the program.

Anyone who has done research into the growing of marijuana knows the Huge profit margin for providers is potentially far beyond what is morally acceptable when it comes to patient’s medication.

As a former English major, I suggest you review your words a couple more times, you do not want to start every statement or paragraph with " I think" or " I believe". It is much more effective to just say what you mean to say instead of adding suggestive words just come out and say " the surplus medical providers medication SHOULD go directly to the patients, eliminating the "guessing " out of the equation. Good luck i. Got a couple friends in NM who are trying to get their cards with little success. Good luck to all

They just had coverage of this on 94Rock at about 7:15AM.TJ Trout says he issued an open invitation to the DPA to come on the air and tell their side and (Trout says) the DPA declined.

You quote producers pulling down 600k.
I would like to know where you got your information.

He did not quote or make claim that any producer is making 600K, he just pointed out that there is no restriction as to how much they can be paid and many non-prof execs have annual salaries that rival those figures.

Search Google for "non-profit salary" and you will find the facts you seek.

Sent an email to the DPA and they replied that they didn't know anything about a 94Rock offer for airtime.Someone has their wires crossed.

Are they talking about removing some qualifying medical conditions?

Severe pain is the condition for 94% Colorado patients. A doctor recommendation is all you need, same in NM? If you have a rec does the DOH still deny anyone?

Here in N.M. to qualify for severe chronic pain you need 2 recommendations one from primary dr. and another from a pain specialist. I don't think they have taken any of the conditions off the list.No I think if you have one of the qualifing conditions you will be approved.

Tough to quantify somebodies pain. Will the dispensary hook a patient up with a doctor? Thats what blew it up here.

A patient is allowed to buy at the dispensary, but only there. Patient can apply for a personal grow permit. Patient can assign a caregiver, the caregiver cant grow but can purchase at the dispensary. Do I have it about right?

I know one producer that says they can help VA patients get a doctor for ptsd. But in general they do not help you with doctors it is hard to find a pain specialist to give you a rec. for pain but it can be done. caregivers here are able to HELP you grow but they can not grow for you.It also has to be grown at your place. They can pick up your meds from the producers
