House Republicans Want To Sue The President For Not Arresting People For Marijuana

The Republican-controlled House passed legislation on Thursday to force President Barack Obama to crack down on states that have legalized marijuana in any form.

Introduced by Reps. Trey Gowdy (R-S.C.), Darrell Issa (R-Calif.), Jim Gerlach (R-Pa.) and House Judiciary Committee Chairman Bob Goodlatte (R-Va.), the ENFORCE the Law Act (H.R. 4138) would allow the House or the Senate to sue the president for "failure to faithfully execute federal laws," including those related toimmigration, health care and marijuana.

"President Obama has established a disturbing pattern of cherry picking the laws he wishes to enforce," Issa said in a statement. "The Constitution charges the President with the responsibility to faithfully execute all the laws and not just the ones he supports."

A Judiciary Committee report submitted by Goodlatte last week regarding H.R. 4138 chastised the Obama administration for selective enforcement of the Controlled Substance Act, which prohibits marijuana outright. "The decision by the Obama administration not to enforce the CSA in entire states is not a a valid exercise of prosecutorial discretion," the report reads. "The guidance of U.S. Attorneys establishes a formal, department-wide policy of selective non-enforcement of an Act of Congress. This infringes on Congress's lawmaking authority, by, in effect, amending the flat prohibitions of the CSA to permit the possession, distribution, and cultivation of marijuana so long as that conduct is in compliance with state law."

The report goes on to describe the Obama administration's actions on marijuana policy as an "impermissible suspension of the law by executive fiat."

But Rep. Earl Blumenauer (D-Ore.) told The Huffington Post that he is not alone in the Capitol in his support of the administration's position not to interfere with state marijuana laws, adding that while states continue to craft sensible marijuana policy, Congress continues to drag its feet with bills like this one.

"It doesn't seem right to me to continue to waste our limited resources punishing people for doing something when it's legal under state law, the majority of Americans want it to be legal, and much more dangerous drugs like heroin are making a comeback," Blumenauer said. "I'd rather stop arresting two–thirds of a million people a year for marijuana possession and generate $100 billion over 10 years through taxes and savings."

Twenty states and the District of Columbia have legalized medical marijuana. Colorado and Washington have legalized recreational marijuana. More than a dozen other states are pursuing legalization in some form over the next several years, and a recent poll showed a majority of Americans want marijuana to be legalized.

Still, the federal government continues to ban the plant, classifying it as a Schedule I substance that is among "the most dangerous" drugs, such as heroin and LSD, that are said to have "no currently accepted medical use."

Passed 233-181, all of the votes in support of the bill were from Republicans, alongside five Democrats, including Reps. John Barrow (Ga.), Collin Peterson (Minn.), Pete Gallego (Texas), Henry Cuellar (Texas) and Nick Rahall (W.Va.).

Some Republicans who have supported relaxed federal marijuana legislation in the past voted Thursday in support of the ENFORCE Act, including Rep. Mike Coffman (Colo.), who joined Colorado Democrats in urging federal regulators to give marijuana-related businesses access to traditional financial services, and Reps. Dana Rohrabacher (Calif.), Justin Amash (Mich.) and Don Young (Alaska), who sponsored the "Respect State Marijuana Laws Act" in 2013 -- a bill explicitly aimed at preventing the federal government from prosecuting state-legal, state-licensed marijuana businesses and their owners.

Rep. Ed Perlmutter (D-Colo.), a sponsor of several marijuana-related bills, told HuffPost that the bill is "not going anywhere in the Senate," where Senate Majority Leader Harry Reid (D-Nev.) confirmed in a statement the bill would be "dead on arrival."

They can pass all the prejudice bills they want in the house who cares its just more of the same from them. It would be nice if they would just do their fucking jobs and stop all this posturing bs. Pass a fucking bill that means something with no other stupid bills attached. Or how about reschedule the fucking plant already. The whole system is lame!

I have oft said repubs and dems are 2 sides of the same coin. Heads they win, tails we lose.

When you look at what they do, both sides are really the same, short of the public posturing. When they come together on an issue we really need to watch out because someone is getting screwed and its not them.

Darrell Issa (R-Calif.) I can see one politician who wont be reelected.

I spend over 4 hrs a day signing petitions, writing letters & calling senators, delegates, etc. & over many more issues than just cannabis. That has nothing to do with being a lone wolf. I'm a lone wolf because I'm sick of a society that sits on their ass & won't stand & fight for their rights! I'm 60 & have been disabled for years. Why can't these younger healthy people fight for their rights too? Takes more than just a few of us to win what we're fighting for, don'cha think? No, politics has little to do with why I'm a lone wolf, that's mainly because people around here are thieves, they walk in your house without knocking, pocket shit when they think you're not looking, & in their drunken state, do hundreds of dollars in damage before they leave! I would love to have my dead mothers wedding ring returned, but that will never happen, but untill it does, I allow no one in my home. Period! Had to stop letting my friends come over because they would have their cars ransacked & robbed, so I sure don't want the ones doing the robbing coming in my house any time they please. So I keep my friends away & allow the thieves into my home? Don't think so. (I'm not in the city, or even town. I'm WAY OUT in the country where this crap USUALLY doesn't happen). I only brought up the lone wolf thing to point out that what ever I do has no effect on anyone else because I stay away from people & keep to myself. Some of my activism may have an affect on them somewhere down the line, but in a good way. No, I'll never move. Owned this place for over 40 yrs, not letting them run me out. They grew up 4 houses from me. Their father had them arrested & put off the property. They occasionally come back to rob some old neighbors. Ones 50, the other close. Neither works, they steel for a living. Both are still in jail for robbing their father, but they'll be out late fall/ early winter. Hopefully AFTER harvest. I hate thieves. Apparently we don't have the 3 strikes law here.
 
Id like to sue the President and ALL members of Congress for not securing our borders as the constitution demands.

You seem to be fairly well-informed, so I believe that you know that the only real reason this administration is so different is due specifically to the groundwork laid during the Bush II administration, by the men I refer to as The Triumvirate, Dick Cheney, Donald Rumsfeld and Karl Rove. Those three men have done more to expand executive powers, starting during the Carter years, than anyone else to my knowledge. So it really began to take firm hold under Bush, and got up its steam during his second term.

And, who in their right mind would then turn around and say, "I want to give up all these new powers!"? C'mon, man.

If people understood how much Congress is really responsible for, then they'd be in jail, promise.

So... BACK to the thread topic at hand and its impact on medical and recreational cannabis, I feel that right now President Obama has a Golden Opportunity, even though he's not up for re-election, to leave a good lasting impact here in the U.S. and use his powers and direct someone, the AG, one of the alphabet agencies, whoever, to reschedule cannabis to Sched. III and be good and fucking done with it. He can do that.
 
This all started in the 80's with the introduction of securitization in banking. After the wheels fell off in 2008 that market is toast now. Thus the velocity of credit has tanked hence the QE 1,2,3 bond buying since then. Like Japan after her bubble burst.

.Gov has been spending like drunken sailors because they had too, made up for joe sixpack second mortgage spending ect, i mean they saved the banks instead of letting them fail.

It does not matter much who is in office regarding spending, but the petty side fights on canna are just for show. The states need tax dollars so the green rush will continue. Maybe not every state will be like co but it will continue. S.S, future obligations demand tax dollars canna brings in.
 
In my opinion, that rep might believe what he's saying but he's not stopping anything. Many states need the money, it has medical behind it now & the understanding of the fact in the old days all this possible tax revenue was not collected. Now they are drooling ....
