any one have a awnser to this?

if i have a medical card ,and test positive to thc in drug test ,can i get fired from my job??
i had a oxycodone prescription and in that case as long as i had a prescpion it was fine

Some are trying to fight this in court but in most cases you are fired because its still illegal federally.

As a former employer from MA, yes. This will change eventually with all the different legalization dominoes set in order, but the key word there is, eventually.

For now, any real company, would have cause to terminate you. In the state of MA (back in 02-14) it could be effective upon receipt of results. Ironically, the reason companies have cause to terminate you, on site, for an offense such as this, is because federal legality has not been revisited. They are now aware you are breaking federal law, not company policy.

A company could also choose not to terminate you for it. It's their prerogative. But companies like that, probably aren't drug testing you in the first place.

So, can you? I can tell you that as of 2013, in the State of MA, you can. I don't know if laws regarding this, have changed since then. I'm no longer an employer.

Will you? It depends on the co, and your value to the co. They don't have to terminate you. So, you would have to assess that.

Funny fact, as an employer, I am (was) not allowed, to ask if a worker's papers were forged. Technically, illegal to do so. And I got handed a passport one time, filled out with crayon. Crayon. I only hired legal people, not on a moral basis, but legal. I've seen lawsuits. I want no part in one.

I could refuse the paperwork, and note that I thought it was fake. But I am not allowed to talk to him/her about any of it. We have to pretend it's not there.

However, I used the same logic.....pretend something isn't happening, even though it is. And I used that, to pretend not to ask them about the documents. Then, I used my ability to speak some latin languages, to figure out where these documents were forged, shook my way up the tree, and I now have several identities and passports for me and the wife...and the dog. In case stuff gets weird.

Thank you guys,I have disc digenation desease five discs on my neck,and bipolar disorter and after 2 years of oxycodone I was hooked,I went to brasil for 4 months clean my self and start using canabis to couple with the pain but once a year I got drug test and is very hard to get clean...so hard that my wife left and took my kid because pinched nerves make me very irritable and misarable.

at your companys discretion as a business they can legally terminate you. my work doesnt recognize mmmj prescriptions, it was briefly touched on in a work meeting.

Right. Medical doesn't even enter the picture. You are committing a federal crime, and they have evidence of it.

I don't know what work you do, or what type of co it is, but, you could explain your story to them. You have to weigh, whether or not, that would go down.

They are not obligated to fire you, but they have cause, and atm in many cases, legal incentive to do so.

But, I have medication resistant seizures. I've seized so much, so violently, that I'm doing permanent brain damage with each seizure. I notice my word recall started to go. I experienced a lot of depersonalization, which, I can tell you now, is awful. It's truly awful. Cannabis is the only thing that stops me from seizing. I feel people like you and I, at least have a pretty good case if you have something to offer the co.

But in the end, yes, they can fire you immediately if they are so inclined.

I am labor and equipment operator in a company that's get paid on federal funds,own by a billionaire,I am just a number to the co.

I live in Ma now and know for facts if you have anything to do with operating a machine of some sort def getting fired. Cant have any drug in your system.

^^He is absolutely correct. If you have random testing, you're screwed. If you have a few hours notice, those cleansing drinks you can get at smoke shops work. I've used them.

If it's a drug test when you started, most companies will only test you again in the case of an accident. If you are driving a company car, heavy equipment, or any machinery at all, and there is an accident, your fault or someone else's, you are likely to be tested.

You either need to be super careful, or have a bottle of that cleansing stuff you can get at a smoke shop. You would need a few hours notice, that gross soda, and a coupe bottles of water.

I have used those masking drinks twice, and passed both times (for an initial test).

And to reiterate, the med card isn't going to help you at all. It's not even a consideration in a Co. like that. It would likely be immediate termination.

From the sounds of where you are, and what you do, they would do the same if you tested positive for oxy, and had a script for it. Any machinery at all. It's been a few years, but as of 2014, if an employee was operating machinery, and was on a drug that has the label of "no driving or operating heavy machinery," and they did so w/out my knowledge, I could fire them, and that's the end of it. There isn't a confidentiality when it comes to letting your employer know that you are "impaired." I was on Oxy for 2 years, and operated better than normal. It sounds like you are the same. But if you were to start such a drug, and be operating machinery, you have an obligation to inform the employer.

And I think most people would agree that depending on the strain, weed, would be more worrisome from an operational aspect. Unless you are a complete opiate lightweight.

i use oxys for about 2 years and once realized i was hooked, i went to brasil for 4 months and got my self clean,but i start to smoke pot heavenly,i am never under the influence in company time but once i am out work i do smoke and a lot ....
its been 16 days i dont smoke and i have 27 flowering plants with makes a lot more difficult,but today i test my self at home and i am clean ....
still have crazy nightmares and i lost about 15 pounds .....ever year i got truth this because my job is seasonal and ever year they makes get a knew medical card .....
i did use cbd oil the first week to brake the edge and it help a little,now i just drink beers ever night trying to couple and i hate drinking never liked,but i got no other option....
i hope in a near future they eliminate cannabis out the drug tests , or i need to consider quit smoking because is just suck have to go truth this once a year .

Yes. A lot of HR companies (ADP for example) operate on a federal level and use that as an excuse. When I worked in MA the company I Worked for switched to ADP. I read the handbook on that issue specifically throughly and then asked questions. It's ridiculous.

It seems like a ton of people here now are from MA? I know Tnelz is in MA too.

We should arrange a summer shindig! I would volunteer to do it, but, I am too sick to take on that type of responsibility. But if someone else organized something, I would be there with some product to burn!

Actually, it doesn't even have to be MA exclusively, I know a couple peeps here are from RI, CT, and VT. We could have our own private Cannabis Cup type event (If someone has a space big enough for that many people to be toking). I know others who do not post on forums from MA who would probably come. Real deal type growers.

If someone could figure that out....it would be "tão legal" (wicked cool). I didn't know there were so many of us here.
