Rec weight is tricky, if my memory serves, technically you are allowed to keep all the weight harvested off you plants, no matter how much but it has to stay where the plants were harvested. So lets say you pull 3 lbs off 3 plants, you can keep it but you must not take it anywhere, sell any of it, or process any of it anywhere other than at the house it was grown in.

On a side note, all this donation stuff with free weed is totally illegal, it is still considered as intent to distribute. If you receive payment for anything in the course of an exchange, you are breaking the law and can be charged. On the rec side you can not even be reimbursed for your time and expenses and on the med side it must be one of your listed patients that you are a caregiver for, not anybody with a red card. You can still give it away, up to an oz but they can not even buy you dinner or a beer for your oz.

I think the weight issue is a gray area that needs further clarification. The law is not as specific as I would like and I'm sure that some local cops will interpret it to mean no more than an ounce dried weight total allowed. From there it would depend upon the court's interpretation and that starts to get expensive. The real point in all of this is if you think you are legal, you should still take care and treat your grow as if it was illegal because long term, you might be better off. You never know when a city council will get a bug up their collective butts and change things on you.

As far as clones go, this is why I've always wanted to sort out a proper grafting procedure to produce a supermom plant that has multiple strains where clones can be obtained. I figure grow a Skunk #1 as the main Mom plant then graft the strains you want to keep. That makes one veg plant of your six.
 
The limit in CO is the number of plants, but think there is a rule regarding weight on hand, someone here will know. The regs are kind of a pain. I routinely count my plants to make sure to be ready in case of an inspection by the state. I never had one and don't know anyone who had one, but feel that they are inevitable because of the history. My cloner is the only place where I could have a problem, but don't think they count as veg plants. Local yokel regs worry me because local governments tend to be populated by the screwballs of the area, who want to get into your business and have some control. Lawyers are expensive.


I do. a cop was looking at a parking dispute in aurora. cop saw a 8" pipe pumping air out of my friends garage.
cop uses her "professional opinion" that "that type of ventilation signified a large scale grow" and obtains a warrant.
friend is caregiver to 5. his roommate held an additional 70 plant count.
cops disregard all paperwork. make him cut down 250 plants... down to 6 per adult on the lease.
roommate shows his 70 count papers. they are ignored. obligatory "odor violation" is also ticketed... even though in veg with no smell and excessive carbon scrubbers.

my friend goes to court and end result, each adult on lease owed the state in excess of 1000 each in fines.

aurora shortly after begun to allow retail shops.

friend no longer lives in aurora.
 
Looking at Section 3, subsection B of Amendment 64, I found the following:

(3) Personal use of marijuana. NOTWITHSTANDING ANY OTHER PROVISION OF
LAW, THE FOLLOWING ACTS ARE NOT UNLAWFUL AND SHALL NOT BE AN OFFENSE
UNDER COLORADO LAW OR THE LAW OF ANY LOCALITY WITHIN COLORADO OR BE
A BASIS FOR SEIZURE OR FORFEITURE OF ASSETS UNDER COLORADO LAW FOR
PERSONS TWENTY-ONE YEARS OF AGE OR OLDER:

(a) POSSESSING, USING, DISPLAYING, PURCHASING, OR TRANSPORTING
MARIJUANA ACCESSORIES OR ONE OUNCE OR LESS OF MARIJUANA.

(b) POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE
THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING
PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE
PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES
PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY,
AND IS NOT MADE AVAILABLE FOR SALE

So a literal reading means ever bit of weed you grow is legal to have so long as you keep it at home. Leave home with no more than an ounce and you should be okay. Just be discreet because you don't want the info out there publicly.

I think it was La Raza who said it best, "We shall not overcome. We shall overwhelm."

But for a home garden, stealth is the key to happiness and security. Nobody should be able to see or smell it or even be aware that it exists. This will change as more people accept it, but it will take a few years, so in the meantime we should try to be legal and good neighbors to the poor people who have not yet become enlightened.:D
 
The guys who wrote A64 told a group in Fort Collins that a med card patient can carry 2 ounces and grow at least 6 rec plants in addition to their 6 med plants. They were less certain about extended plant counts, but did mention an affirmative defense if it became an issue. They also suggested stealth as the best first step and mentioned that firearms are a big problem, both at home and conceal carry. They said to steer clear of any firearms to avoid big potential trouble. Put a lock on the door to the garden also, just to ensure compliance.

I suspect eventually home growing will become similar to home brewing in that there will be a maximum annual production amount. Currently, beer is 100 gallons per year per adult with no more than 200 gallons in a year regardless of the number of adults.

Sad that you have to give up your right to have a gun just to stay safe. :(

But still wouldnt be allowed to exceed the max 12 per household? these laws make no sense!
 
and at some point, someone living in a multiple occupant situation will take it to court and the city or municipality will have to explain why they can strip the rights per the colorado constitution for one or more people living in a large house of, lets say, 5 people. A 12 plant count effectively removes the constitutional rights of 3 of those people which I do not believe the town or city council has the authority to do.... just a matter of time until someone fights that particular fight, which, I believe is a fight no city really wants.
