I need Advice- Were being Evicted from our Apartment....

Alright, ill keep this as brief as possible.

June 23rd I filed a complaint with Maint. because our AC hadnt been cooling our apartment ever since it started getting hot.

Next day, some guy from the apartment complex comes, does some work on the AC, and then later that night I am woken up by the smell of smoke and plastic, turns out whatever he did had caused the AC unit motor in the attic to catch fire.

So they gave us a Portable AC (we have a 7month old infant child) to cool the house. It wouldnt work at all. The house stayed at 97 degrees all day until night time when it would drop to 90. Later we found out that the Portable AC had been improperly installed and that is why it wasnt working right but we did not know that at the time. So we were forced to go to a hotel.

The "fixed" it but then the next day while doing laundry we realize a leak from the ceiling. The unit is still only going down to 78-79 (which is livable for sure) but is leaking 5-10 gallons of water per day from the ceiling. We are constantly switching out towels and emptying the 5-gal bucket of water...

July 1st came around and the Unit still has not been fixed. Today is July 7th, and it is still not fixed. Each time the professional company has come out, they have told us that they have been here for the AC unit for the last 2 tenets also and that they have now recommended 2 times for a completely new AC system to be installed.

Yesterday we were served with 5-day written notice to either Pay or Vacate. We have already begun our search for another place but with us working that makes it difficult to allocate time to viewing apartments. My understanding of the process is the next step will be for the judge to set a date for a hearing and for both parties to then have the opportunity to tell their side of the story.

So my question is; What would you do in my situation. Stand your ground and move out. Go to the hearing and paint the out to be the slumlord that they are, or Just pay the rent + late fees and everything else, live here 2 more months and then move out when the lease is over.

Additionally, when the water all began leaking from the ceiling, we had a brand new twin mattress ruined. A nice 350W CMH Horticulture light which was in a box in that room.

We feel all this began and has happened because their employee did work to the AC unit which resulted in a fire and all these additional problems and damages.... not to mention the emotional distress it causes a family with an infant to have to scramble to find a new apartment or potential homelessness....

Before we withheld rent, we offered many forms of assistance that would have been sufficient such as paying for the 1 night + 1 day we had to spend in the hotel when the house was at 97 degrees, offered assistance with electric bill since we have now been running portable AC for 18-hours a day which has more than doubled our energy consumption, or to even just pro-rate the few days the place was "inhabitable," and remove that from our bill... our company was super rude and told us to kick rocks essentially. Word for word they said their company policy was to provide 1 portable AC in this situation and that was all they could do.

We informed them of our 8month old son and the danger to his health. They did not give a fuck.

So again, I appreciate anyone who read this....

What would you do in my shoes?

Obviously, you need to get out of there.

I'd also get as much evidence as possible for all the events that took place, including pictures of all damage, and see if a lawyer would sue the landlord for you, payment contingent on winning the case.

I am NOT a lawyer, but I think we all know just because an injustice was done doesn't mean you'll get satisfaction.

I am definitely keeping pictures of and documenting everything in like a day-by-day log.

I was able to talk to the managing company's regional manager today for a little bit via email. Nothing has been accomplished and I am not very optimistic either. This entire company seems to look at their tenants more like slaves than paying customers.

But I guess when the housing market is as hot as it is and affordable apartments are in extremely high demand, they can do whatever the fuck they want.

Im not an HVAC specialist nor am I certified/ authorized to perform any work on a leased property.

The issue was finally fixed. They put in a completely new AC system including new lines. But it took 3 weeks of dealing with their bullshit.

Looks like we are set for a court date.

Seriously dude you don't want to know what I would do I oh, I know who they are and I know where they live... this is where I say no more about what I would do 333 sorry for your terrible problems I would normally say enjoy what you can and forget about the rest , I can guarantee it won't last long ... But it may not apply here Mission Point! But please do yourself a favor and stay out of trouble he's not worth👴 keep cool dude👤😎😇

PM companies tend to have lawyers on staff, and with an infant child, the stress of courts + costs + an infant is a terrible recipe. Unfortunately, you're between a rock and hard place. If you fight, you're likely to incur absurdly high costs without any justice rendered. AND likely to still end up with a late/no payment on your credit and a poor reference in your rental history. You'll end up suffering for years and it won't matter two shits to the PM company. If you win the fight, you're no better off. If no one ended up sick/injured, a judge likely won't award damages. You could try to drag in the media, but since the problem is fixed now, it's a non-issue headline. Your best bet is drop the court date, suck it up for two months, and gtfo. Hopefully they'll just say you paid your rent on time and were a decent tenant. Leave the place spotless as you can.

I agree we are likely in an uphill battle but we are going to see it through. We sign a new lease for a bigger place in a couple days and will be able to move the following weekend. I am not sure how quickly the Eviction Courts are moving but I cant see us getting a court date for prior to August, so in all likelihood we will have finished moving out before we have our court appearance for the "Eviction,"

We are going to claim that the landlord violated the lease when they did not fix the AC for 3 weeks. In Arizona the landlord has 5 days after receiving written notice about a Material Non-Compliance with Lease and if the issue is not fixed, the tenant has the right to terminate the lease agreement. That is what we will be arguing at least, that the problem began June 23rd (We are in month 9 of our 12 month lease and have always paid rent on time) and when July 1st came and the issue had not been fixed, we decided to dissolve the lease and move out. The issue ended up being fixed but not until July 13th-14th.....

So hopefully a judge rules in our favor in that regard. Agrees that we were within our rights to terminate the lease and move-out.

I think if the PM is going to want to get money for the broken lease they would need to pursue a separate civil claim for breach of contract, but I have never gone through this process before so I am not sure. It is at this time, if they do pursue and try to collect for July rent and/or August and September, we plan to counter and bring up all our damages, stress, hotel costs, etc.... might even be able to hit them with the costs of moving to a new apartment with working AC.

At this point, if they are willing to let us just leave at the end of the month and cancel our lease then we would be satisfied I think.

I'd be careful citing laws unless you and your cohabitant (obviously not the infant) are legally versed, ie law school learned. However, AZ is unique in their inhabitant laws given the insane heat down there. I lived in Phoenix for a while and the laws are... interesting, so you likely are the better side of a bad situation. Taking it to civil is worst case scenario, been there done that (with a PHX based PM co.). Again, their legal team will drag it out, delay, etc. You'll end up footing the bill on fees and out a bunch of money for nothing. Best case they drop the case and you best walk away bitter and knowing you'll never deal with them again.

Glad to hear you are on your way out. Just keep a cool head, even if it's sweaty. And take your shoes off before walking inside, tracking asphalt inside is uncouth.

That is a pretty ignorant thing to say, "dont cite law unless youve attended law school." but I will forgive you as I know many people who do profess to know legal information but are often inaccurate or misinformed. We all say dumb shit sometimes.

In our case the law is AZ Statute ARS 33-1361(A) which requires landlords to maintain the residence in "habitable condition and reasonable repair." The fact that we have an infant living in the house also adds to the issues of safety. In Arizona if the landlord does not correct the issues within 5 days it allows for the tenant to take corrective action, up-to and including termination of lease, lawyers fees, and costs of obtaining alternative shelter. So technically we could counter sue for the cost of moving and everything else we have incurred. At least this is my understanding of the law.

We will not have any legal fees because we do not plan on hiring an attorney. Dragging it out makes no difference to us at all. Again, we sign a new lease tomorrow and will be 90% moved out by the end of next weekend.

I am sure a court date will be coming in the mail soon but at least we will have a new lease signed before that happens.

This process is definitely causing a lot of stress and anxiety for me and for my wife. She is taking it worse than me since I have been through similar situations and I have been homeless before, she hasnt. So I will be happy when this is all behind us. I will update this thread occasionally for anyone interested on how the whole situation ends up playing out.

Dont know your laws but some states allow you to put rent into escrow with the county(gotta go to court first) after petitioning the court for the landlord to fix it. He doesnt you walk away rebt free and the money. I think this is to help tge tenant get a new place with that money..

Interesting. I have not heard of this

We signed a lease for our new place this morning and payed rent for end of July and August. We get the keys and move-in next weekend

Still got to deal with this mess though. We will take it as it comes I suppose. Hopefully nothing crazy happens during this last week.

Then you guys don't realize this or not but for the last couple of years there's been a block on being evicted from any apartment or housing complex due to the not completely but mostly hoaxed " flu" conveniently created pandemic 33 which was originally SARS and then had been mutated into flu which is now call flu dash – – Mexico probably had something against naming it flu due to the fact Corona beer is there most precious resource besides tequila and mezcal... but I was not trying to get anybody into a discussion over politics, religion, or sexuality they all seem to turn the best of friends in the worst of enemies! I was only saying maybe it was illegal for them to evict you at this point in time!? Due to this supposed virus that actuality only killed 5% of the overall amount reported by hospitals and doctors in order for them to collect much much larger fee on victims of flu! - - - - - but if you've already pulled out I doubt if you'll be able to get compensated or anything done maybe you can get your first and last months rent back anyway the warden was once a apartment manager in California she reminded me about the no can do evictions in the United States when I mentioned you were asking for advice ? You must be a trumper, I’m not sure if you realize or not but it’s the republicans who keep blocking cannabis legalization. I’m Kansas our governor who’s a dem keeps getting blocked by our house which is controlled by republicans. Or maybe your one of those q anon weirdos.
