Here's an example to show how it's totally illegal to sell or give away for "minimum donation" any part of the plant:
The police are doing an undercover sting right before November voting to sway voters away from what many have fought hard for, they will state that patients are skirting the law with play on words. So they answere an add on CL (of some poor soul who's life is about to change) who is giving a clone away for $20,00 (or states outright selling it lol), the CL MMJ patient is cautious and decides to meet in a parking lot for security sake and look at the card of the undercover agent (who may even be a patient that will also raid the dr who gave him the recommendation) the undercover cop has his team waiting and watching, every word being recorded.
He asks to see the clone (cutting or rooted) and says thanks man and gives the CL poster $5.00 if the CL poster is smart he says k see ya later and happily waves goodby. He thinks to himself "well he only got one clone not 12, he wont get another one from me, wonder if he was a cop?".
Now what likely will happen is what the cop hopes (ask yourself if it's how you would react) and the patient will say "hey that's suppose to be $20.00 you owe me &15.00 or pull out a gun thinking he is in the right and that he is being robbed,, BOOOM,,, dead, news at 6 and we all pay. As soon as you say those words, your attorney has his hands full saying you didn't mean to profit off that plant, your motivation wasn't to help out a patient, it was to make money. Anybody thinks I'm wrong they can go to the FBI building and ask, i've been there before asking questions, that's what I thought,,,,,,no takers. fyi RICO can bite you in the ass if that guy you "sold" the clone to gets busted.
Being one of the first to get my card i had to re-certify the beginning of last month, you now have to acknowledge a disclaimer on the department of health website that you acknowledge it's illegal under federal law, regardless of state law.
So be careful, consult an attorney, many are worried now about RICO though giving advice to dispensaries could be a problem even for an attorney. What I would do is meet with a patient first and only have one clone (as a security measure, wink) , state what u suggest you would be happy with for a donation and that you are grateful. If the patient gives you what you are hoping for, then give him/her some more, this applies to meds too, a couple grams first, if they rip you off who cares it's only 2 grams. There is nothing in the law that states if you suggest a donation amount and they give you less that you have to give to them again if they answer your add again, in fact have them meet you across town and just don't show up lol..
