Funny you mention "Discrimination"... I am currently contemplating opening A door for A Class Action based on the words of the Supreme Court and the United States Government with Case president already established... via. an Attorney Pro Bono... I'm sure there are some smart ones out there so here is the basics...
I am by no means A Harvard Law Professor but I do "Live" within the boundaries of law... ;) and have the ability to interpret and simplify things made needlessly complex...
So, based on the statement so often made by NASCAR (they only turn to the left) politicians... If Obama Care is "The Law of the Land" as so often stated... Shouted from the top of the Senate Hill by Harry Reid himself... (worm) and Re Written and Supported as A mandated "Tax" by the Supreme Court :wideyed:...
If they are "All" held true to their words... Including the Highest Court of the Land... Does Obama himself have the Authority to "Choose" people or groups that "He" Will or Will Not Impose A Tax On or Exempt From, without voted consent of, the House or Senate???
I'm No Attorney but I smell Class Action Law Suits in the Future of Obama Care based on the discriminate selection of Who will Pay and Who will Not determined solely by Political, Union, Business affiliation... or the amount of income you possess or do not... :woot:
The President...
Sovereign immunity in the United States
Exceptions and abrogation
There are exceptions to the doctrine of sovereign immunities derived from the 11th amendment:
Discrimination
If the state or local government entities receive federal funding (I.E. Taxes) for whatever purpose, they cannot claim sovereign immunity if they are sued in federal court for discrimination. The
United States Code, Title 42, Section 2000d-7 explicitly says this.
Doe v. Nebraska in the
8th Circuit[3] and
Thomas v. University of Houston of the
5th Circuit[4] have held that, as long as the state entity receives federal funding, then the sovereign immunity for discrimination cases is not abrogated, but voluntarily waived.
So... Lets hear what people think
