Got Raided. 24 Ounces And 100 Plants. How Screwed Am I?

Hes confusing two things with 1, Theres Discovery where the prosecution has to turn over all evidence they have against you to the defense, Then theres the right to face your accuser which is easily side stepped when the state brings the charges against the person vs you. Vs Him which is more common in civil cases.

In almost all criminal cases these days its The State your charged in / Circuit court or District court depending on the severity of the charged.

Assault another person, you have the right to subpoena them to testify in court but the charges would be you Vs The state, Even if the assaulted wanted to drop the charges the state would pick them up. Sneeky fucking bastards they are..

had a signed search warrant. How they got it is beyond me, no one has even really been in my house. I guess ill find out.

neighbor snitching....its ALWAYS a neighbor snitching...99% of the time...they dont like you or are unhappy with the way you cut your grass, or hate on you cuz you living good...either way its always a neighbor snitching that opens up investigation

the criminal justice system is a huge business...a very profitable one... its very discouraging knowing about some of these laws and how they do absolutely nothing to protect anyone, just in place to charge someone for profit... attorney fees,court fees, probation fees, etc etc etc...

curious was it local, state or feds that raided you?

and even more so once states started signing contracts with private industry to run the prisons. the states by contract are bound to keeping X number of beds filled per contract. When they fail to do so there are STIFF economic penalty clauses for missing their counts. Good motivation I would say to keep the head counts up.

Yes the DEA raided my place. They found 100 plants and 20 ounces or so. They were not happy with what they found. They had no idea I even had a grow at my house, they were pissed they had to carry all the plants out. It was really a weird vibe....im thinking they thought I had a lot more or hard drugs or something? i dunno.

before they left they told me, "hey man if your gonna do this you have to stay within your 72 count. this is such a small case were not going to charge you."

Then my lawyer talked to them a few days later and they told him they were not charging me either. case was way too small.

but they are sending all the evidence to the county prosecutor. I live in the most dangerous county in America. 300+ murders per year etc. My lawyer told me this is the best county to commit a non violent crime in, due to the judges seeing murders/rapists/violence all day. We will see.

I have not been charged yet. I dont know how long it should take?
And I thought the DEA is/was supposed to be on stand down due to the new legislation from Congress not allotting funds for the average grower. When will the madness end???

Answer to that issue is run your security and TELL NO ONE. Then the neighbor cant snitch unless you let him in on your secret. How would a neighbor know anyway?

You know @Joe Fresh you are correct. there needs to be a change in that as the law should have to have more than a irate neighbors say so to validate a search warrant. Getting a warrant based on he said she said has actually resulted in deaths due to CI's giving LEO false information and as a result innocent people have died during the raids. Thank the creator that most of my neighbors puff and I get along with all of them. But with that said not a one will I trust enough to let them know I grow.

Everyone I know that has ever been snitched on 100% of the time got a full evidence report and investigation report which included the full name of the snitch the dates they cooperated with police and all that etc. Don't know the name of it or how to go about it but everyone's lawyer did that for them ASAP. (They all had court dates)

Nice that your able to walk away a free man. That is good news.

Make sure moving forward you are always in compliance should they ever decide to check up on you 6 months from now!!!

The feds passed on my case. But they sent the evidence to the county, which they can press charges if they decide. The county/state has 5 years from the date of the raid to press charges.

Im just praying the county goes easy on me due to all the problems this county has. Compared to the other crimes that happen on a daily basis here.

back in 08 i.was busted in idaho.... got charged with 4 felonies... ended up doing a bit more han a year in the pen. i had zeeo medical defense and was fully exposed... with bout 7 lbs of trainwreck... i had a good attourney... so get yo researching which one u shouldninvest in.... lemmee know if i can help u by sharing more...

Don't live in fear bro that's what they want. Usually with cases that get delayed its because there is so many people doing it they have no where to put you. In my experience they wait to charge you, if you were any bit out of compliance they most likely will charge eventually. Then it will take a couple years of your lawyer delaying trials with bullshit excuses and so on. They will threaten you with take this felony no jail time this is your last chance.... Eventually they will offer you a differed felony even thought they told you no before. They will not want to take to trial I promise, cost state to much money.

Oh and I was charged with felony cultivation and felony menacing with 60 plants over the limit:D I paid a lawyer almost 10 grand to show up to court for three years to bullshit our way through it. In the end I got a differed felony menacing and a misdemeanor pot charge.
My bro was charged in cultivation about the same time hechose a public defender and still got the differed!! :eek:
