There are no real plant limits except a rather arbitrary federal number of 99, because apparently three digits instead of two really makes a difference in this world. You have to be able to support the plant counts. No city or county government may impose any plant limits is how I understand the current situation, at least not when seeking prosecution.
Garden of Dreams (much closer to you in the OC) and I have both consulted attorneys, he's got a pretty notable one on his roster whose name I am now forgetting! In any event, being able to support plant count is key, and pertinent to my other questions regarding cooperatives and collectives in SD Co/Escondido.
If they had no warrant, depending on circumstances, they can claim smell as probable cause as relayed to me directly by my own attorney. My living situation is somewhat different from yours, but someone who is on probation has moved out, so now I have much less to worry about and am not required to let the po-po in as I previously was. Still doesn't negate smell as probable cause, but kicking your down down I don't believe is the appropriate action, not sans warrant.
