That is a very good point. If you go to court, and it is most always small calms court, the Judge is not bound by a strict set of guidelines. Therefor he acts on his emotions. Many times he/she will side with the poor little tenant against the landlord.
I had an issue with a non-landlord, just a guy who owned a house and wanted to cash flow it. No move in walk through or inspection, and after the initial lease period he wanted to sell the house but kept the entire deposit, saying he did a walkthough inspection before we moved in and after we moved out, and that was where he got to keep my deposit.

Having ties to the construction industry we were able to fix the broken swamp cooler, replace fences after a windstorm, etc etc. The landlord held us responsible for a scratch on the formica counter, charging us for a new granite counter.

Knowing the landlord has a month to explain in writing why and how he kept the deposit, we waited that long and asked for the deposit back. We got a 'fuck off' letter instead of an itemized breakdown of why they were keeping our deposit. He said they did a walkthrough with video before and after, but nothing was ever signed by us. I sent him a document discussing treble damages and what he'd be liable for. When he got a court summons we got a check the same day. Not landlords should not ever be landlords. A lot of homeowners want free money and renters want free grow space they can trash.

Lose/lose. The rental company for grow houses is an interesting concept, but it's got too many risks. I am in the insurance industry and I am not aware of any carrier who would cover cultivation of marijuana, medical recreational or otherwise. Multi-site multi-state companies are bound by federal rules, not state rules. I guess a Colorado insurance carrier might cover it, but Rocky Mountain Health Plans is the only carrier based here that is worth mentioning, and they would never cover something that is related to a federally illegal enterprise.

I still like wapner, he was the greatest. Although judy just destroys people.

I think Judy is in civil court. More formal than Small Claims. Like Fishwhistle (hookup) and Sea referred to.....even if you get a settlement you still have to collect. Judge will usually give a month to pay and then garnishment proceedings begin. If the guy is a transient like most cases like this all he has to do is change jobs and you have to go through the entire paperwork process again and again until most just say fuck it and move on.

@ LGG....my rentals are in a small town and everybody knows everybody. If you just randomly start keeping deposits everybody will know. I will never take advantage of a tenant that treated me, the lease and the property well. I ALWAYS return the deposit.
One thing I think you are absolutely correct about is damage cased by a grow op. I think the insurance company will not pay or be held liable.

I don't think I have ever been able to rent a place without reference checks, proof of income, employment history, etc. My place is crappy, still had to provide all those things. Thankfully they waived the reference checks since I had owned a house and hadn't rented in years before moving out here, still had to show that I did legitimately own a home as the reason I did not have a recent rental history.

Quit renting to transients man, and don't buy into peoples hard luck stories. Sounds like background checks would have helped out in all these situations. I can understand a reluctance to do that, but not doing it got you screwed over.

This. I came here 10 years ago to put down roots, let them sink deep, not deplete the soil and leave it barren. There will always be transient types who are better off renting trailer spaces than actual homes, don't rent homes to them.

@xavier7995...I do those things as well including credit check. When the economy is good like now you can be very pick and take your time on who you rent to. I always look at their car as well....you can tell a lot by looking at a car. I don't mean to make it sound like I have constant problems. But sometimes people get by you. After 16 years of renting.....My experience with the legal system came from work. Oh, also when they are looking the place over with the possibility of renting....if they talk to much RUN!!

Coupla points that are specific to California.

All small claims cases are civil in nature, as opposed to criminal. It is the amount being sued for that determines whether it's a small claims case (limit is $10K in CA, and you have a time limit for filing, as well as a time limitor for how many small claims cases you have filed within a particular period of time, which is ostensibly to protect from vexacious litigants. Yes, it's a thing) or has to be heard in civil court, which usually means an attorney is presenting the case so all of the rules of comport, etc, are a lot more like a criminal court. Small claims is more casual, but how much usually depends on the jurist.

Then, it isn't the judge who determines (or even tells you) the waiting period before filing a lien or levy against wages. Here, it's 30 days after receiving your copy of the judgement in the mail, this is your properly stamped copy that you then get to present to the collecting agency in the county you plan to collect. In other words, in order to levy the garnishment it has to be logged in the county where the defendant works (not resides!). You may not file any garnishment before this waiting period occurs.

After ALL of that, let's say you've got your garnishment. Let's say the defendant isn't a transient. Let's say all of those disqualifiers don't exist. After ALL of that, the defendant is allowed a certain minimum 'take home' level of pay, from which no garnishments from civil judgements may occur (outside, I believe, of agencies such as federal or state agencies, and child support is also handled differently). Beyond that, you're golden.

So these mythical landlords I spoke of who want their tenants to prosper and continue to pay them rent... they really exist? Cuz I was just bullshitting and blowing smoke.

WTF else would I do on this site? lol, it'll never be even a shadow of what overgrow was, so mostly I check on it to trade insults with people I don't see regularly in real life.

it's the " perfect storm " that has destroyed most forums' ....

a). the early forums filled with new / old growers talking about issues good and bad learning from each other.

b). genetics traded for the love of the game. ( everything good was just kine buds or called by its landrace origination point - afghani, columbian gold ..... )

c). the influx of different names, breeding ( nevil ) introduced marketing into the mix. the selling of genetics for profit was introduced, clone only hype-train gathered pace - dead show hype, magic seeds producing one of a kind genetics was sold very hard on the forums. groups of " friends / pimps " talking up hype train enveloped the forums / california , clone clubs, once those seeking profit jumped on the train they traveled the forums laying the track for hype / sales ...... this has only gathered pace since the late 90's and " took over " the forums.

d). the power of marketing, growing good plants, and good camera skillz soon trumped everything. the " insiders " soon ran with this simple recipe and have used it over and over and over again ........ pure hype train. putting lipstick on a pig- the young bucks coming online wanted in, the insiders had the hyped up clone only's and if you pulled the rope with them you would be rewarded with online status and rep with everyone " fluffing " each other like a porn expo at caesars palace .....

e). we now sit with every tom, dick, and harry tossing pollen on polyhybrids so watered down its unreal. true F1's getting sold or worked lines today ??????? lol'. couple this with the price drop because of more product on the streets because more states that are legal and more growers coming online.

money & greed. and all the people who never spoke out about said corruption is laughable .....

heck half the industry is built upon a dead show mythical bag of bud that held 5-8 " magic " seeds that produced the all time greatest plants that have never been duplicated. this bed time story alone should have been called out from day one but it was not, it was slathered in bullshit and hype and served with a side of carrots ...... a " keeper " one good plant, sure, lots of keeper plants found in n.l. / haze also. but the over the top marketing hype was perpetuated and encouraged on many, many levels.

now everyone is sitting back asking " what happened " ?........ very sad indeed. rome has been burning for a very long time, instead of more gas " hype " a few more peeps should have tossed the cold water of reality, maybe some tried ? but the shark was jumped long ago -
