A state review has identified weaknesses in cannabis testing, inspections and consumer alerts, raising questions about how effectively Colorado keeps potentially unsafe products off dispensary shelves. Colorado’s cannabis safety system has significant gaps that could allow contaminated or inaccurately labeled products to reach consumers, according to a state performance audit released October 19. The review examined oversight by the Marijuana Enforcement Division, known as MED, and the Colorado Department of Public Health and Environment. Auditors identified problems across several layers of the system, including laboratory oversight, product testing, business inspections and the speed of public warnings. The findings put renewed attention on a basic promise of legalization: consumers should be able to buy cannabis from a licensed business with confidence that meaningful safety checks stand behind it. Thousands of harvest batches went untested One of the audit’s most striking findings concerns Colorado’s Reduced Testing Allowance program, which allows qualifying businesses to perform certain tests less frequently. Auditors examined records associated with 207 participating cultivators that were active at the end of 2025. Those records showed that approximately 41,000 harvest batches went untested between January 2023 and December 2025, representing 26% of the nearly 160,000 batches included in MED’s program report. That figure describes a gap in testing coverage. It does not establish that those batches were contaminated. Reduced testing is intended to lower costs for businesses that demonstrate consistent compliance. However, auditors found weaknesses in how eligibility and continued participation were monitored. They also identified limitations in the information available to regulators about which businesses qualified for exemptions. For growers, the distinction matters: previous passing results can support confidence in a production process, but regulators still need a reliable way to check whether the conditions supporting reduced testing remain in place. The sample reaching the lab matters The audit also brings attention to who selects cannabis for testing. Colorado allows businesses to collect the samples they submit to private laboratories. That creates a potential weakness before laboratory analysis even begins: a carefully selected sample may not represent the full batch available to consumers. Earlier reporting cited in coverage of the audit documented cases involving samples that differed from products sold in stores, along with other testing violations. A laboratory can accurately analyze the material it receives while the result still gives an incomplete picture of the wider batch. This makes sample collection, documentation and independent checks central parts of a credible testing system. The practical question extends beyond whether a certificate shows a passing result. Buyers and regulators also need confidence that the tested material fairly represents the product carrying that certificate. Public warnings arrived months after products reached consumers The time taken to warn consumers was another major concern. According to The Denver Gazette’s reporting on the audit, products eventually covered by health and safety advisories had been on the market for more than seven months on average during the 2023–2025 review period. In some cases, the period exceeded three years. That interval includes time before regulators became aware of a problem; it should not be interpreted as proof that officials knowingly allowed every affected product to remain available throughout that period. However, the review also identified delays within the response process. A more focused examination of 2025 cases found that investigations took roughly three and a half months, on average, to reach a public advisory. Around a month could pass even after investigators determined that a warning was needed. A warning issued after a purchase may still help consumers identify affected products, but its usefulness depends heavily on how quickly it reaches them. Inspections and laboratory oversight need improvement Testing was only one part of the problem. The Denver Gazette reported that some businesses had gone as long as five years without an inspection, despite MED’s goal of conducting an on-site inspection at least once every two years. The audit’s published highlights also identified shortcomings in oversight of private testing laboratories and the absence of a fully functional state reference laboratory capable of providing comprehensive independent testing support. Together, those weaknesses affect the state’s ability to verify compliance, compare results and investigate concerns. Auditors called for stronger monitoring and clearer communication, while recognizing that Colorado already has a regulatory framework that provides some assurance of product safety. Earlier recalls show why follow-through matters The findings follow previous reporting about contaminated products and delays in Colorado’s safety response. In September, The Denver Gazette and ProPublica reported that manufacturer StayCon had voluntarily recalled 49 products after methylene chloride was detected. The recalled products included cannabis vapes, and the company’s notice identified a botanically derived flavoring ingredient as the source of contamination. That case illustrates why oversight must extend beyond cultivation. Finished products can contain additional ingredients, and the safety of those inputs also needs scrutiny. A system that checks flower production but misses a contaminated ingredient introduced during manufacturing can still leave consumers exposed. Effective oversight needs to follow the product through processing, packaging and retail distribution. What the findings mean for growers and buyers For the THCFarmer community, the audit raises practical questions about the relationship between good growing practices and reliable verification. Growers put considerable effort into clean production, drying, storage and handling. A trustworthy testing system should help distinguish that work and give buyers useful information about what they are purchasing. Product conditions can also change after an initial test. In earlier reporting by Colorado Public Radio, industry specialists explained how humidity and storage conditions can allow microbial growth later in the supply chain. That makes retail checks and clear recall notices valuable additions to initial compliance testing. Consumers also need enough information to recognize an affected purchase. Colorado Public Radio previously highlighted concerns about notices that rely heavily on batch identifiers without making the associated consumer brands sufficiently clear. A warning works best when people can connect it to the package in their hands. Agencies accept recommendations, but changes will take time The audit’s highlights list 14 recommendations, with the agencies agreeing to all 14. Their acceptance does not mean every proposed improvement is already operating. The report’s responses set different implementation dates, including work scheduled for 2027 and a broader inspection strategy extending into March 2028. MED senior director Dominique Mendiola told lawmakers that the recommendations would guide further improvements to the agency’s work, according to The Denver Gazette. The next test will be implementation: whether Colorado improves sampling controls, makes inspections more consistent and gets useful warnings to consumers faster. For a legal market built partly on the promise of safer, accountable production, those are measures that growers and buyers have good reason to watch. A Michigan cannabis contract dispute is raising a costly question for licensed growers: can they recover their losses in federal court when a buyer walks away from a harvest agreement? NORML is backing an effort to reconsider a federal appeals court ruling that overturned a $31.8 million jury verdict won by Michigan cultivator Hello Farms against two Curaleaf subsidiaries. According to October 18 reporting by The Marijuana Herald, the marijuana reform organization has submitted a brief supporting reconsideration of the Sixth Circuit’s decision. NORML argues that federal marijuana prohibition should not automatically prevent a business from recovering damages after another company breaches a cannabis supply agreement. The dispute reaches beyond the money at stake between these companies. It concerns the legal protection available to businesses that grow and sell cannabis under state licenses but remain exposed to conflicting federal rules. For growers committing an entire harvest to a buyer, the case puts the reliability of those purchase agreements under scrutiny. The Harvest Agreement Behind the Lawsuit The case began with a November 2020 agreement involving Hello Farms Licensing MI, GR Vending MI and CURA MI. GR Vending agreed to purchase Hello Farms’ cannabis production from its 2020 and 2021 harvests. CURA MI guaranteed GR Vending’s obligations. Both buyers’ entities are subsidiaries of Curaleaf Holdings. According to the appellate court’s account, the agreement anticipated a 2020 harvest of approximately 12,000 to 15,000 pounds. Hello Farms ultimately produced around 16,300 pounds, all of which passed the testing required by the contract. GR Vending paid a $2.2 million deposit and accepted approximately 2,000 pounds. By January 2021, cannabis prices had fallen sharply, and the company stopped accepting additional deliveries. Hello Farms sold the remaining 2020 crop to another buyer at lower prices. It also sold its larger 2021 harvest to that buyer for less than it would have received under the original agreement. The grower sued to recover its losses. A Jury Award Followed by an Appellate Reversal Hello Farms initially filed its lawsuit in Michigan state court. The defendants moved the case into federal court under diversity jurisdiction, which allows certain disputes between parties with different state citizenship to proceed in the federal system. The defendants argued that the supply agreement could not be enforced because it involved conduct prohibited by the federal Controlled Substances Act. The district court rejected that defense, and a jury awarded Hello Farms $31.8 million. The Curaleaf subsidiaries appealed. On September 10, 2026, the U.S. Court of Appeals for the Sixth Circuit reversed the decision. The panel concluded that federal courts could not enforce this agreement because the underlying marijuana transactions violated federal law. The reversal turned on whether the agreement was enforceable in federal court. Having accepted the defendants’ federal illegality argument, the appeals court did not decide their separate challenge to whether the evidence supported the size of the jury award. Why Seeking Money Did Not Resolve the Problem A central issue was whether a court could award financial compensation for the broken agreement without improperly enforcing federally prohibited conduct. Hello Farms sought lost profits arising from GR Vending’s failure to purchase its harvests. The panel concluded that awarding those damages would still enforce the underlying cannabis bargain. In its analysis of the decision, law firm Thompson Coburn explained that framing the claim as a request for money did not overcome the court’s objection. The damages depended on a purchase agreement the panel regarded as federally illegal. The court also said the principle applied in either direction. A buyer seeking damages from a grower that refused to deliver marijuana would face the same underlying problem. NORML’s intervention challenges the use of federal prohibition as a categorical barrier to recovering contract damages. Its position supports Hello Farms’ effort to have the court revisit that result. Medical Cannabis Protections Did Not Save the Agreement Hello Farms’ medical cannabis status formed another part of the dispute. The company held Michigan medical cultivation licenses when it entered the agreement. However, the majority concluded that the contract was not restricted to supplying the medical market. Among the details it considered were requirements for recreational cannabis testing, GR Vending’s medical and recreational licenses, and Michigan rules allowing certain transfers between medical and recreational inventories. The court also considered federal spending restrictions associated with the Rohrabacher-Farr Amendment. Those restrictions limit the Justice Department’s ability to use covered funds against qualifying state medical cannabis activity. The panel concluded that those limits did not make the underlying transactions federally lawful. As Ice Miller explained in its analysis, the court also rejected reliance on the April 2026 federal medical marijuana rescheduling rule. It found that the rule did not retroactively validate the 2020 agreement. The panel further noted that federal registration requirements remained relevant to whether medical marijuana transactions were lawful. What NORML Is Asking the Court to Reconsider Hello Farms filed its rehearing petition on October 8, according to The Marijuana Herald. The grower warned that the decision could destabilize commercial relationships in regulated cannabis markets. NORML’s supporting brief adds a national advocacy organization to that effort. Its argument focuses on whether federal illegality should automatically defeat a damages claim after a cannabis purchaser breaks its agreement. The distinction between a filing and a court decision remains important. NORML’s brief supports reconsideration; it does not itself grant rehearing or restore the jury award. The case remains identified as Hello Farms Licensing MI, LLC v. GR Vending MI, LLC, No. 25-1759. Why the Dispute Matters to Other Growers The Sixth Circuit covers Michigan, Ohio, Kentucky and Tennessee. Its published decision binds federal courts within that circuit, while federal courts elsewhere can reach different conclusions. The ruling also does not automatically invalidate every agreement involving a cannabis company. The nature of the transaction and the court hearing the dispute remain important. For cultivators, the commercial concern is straightforward: a harvest agreement can shape planting decisions, production spending and expected income months before delivery. If recovering losses becomes uncertain after a buyer defaults, the grower’s exposure can extend well beyond the unsold flower. That is a practical implication of the ruling, rather than a separate finding about every cannabis business. Thompson Coburn’s analysis identifies payment structures, forum selection and arbitration as issues businesses may need to examine. It also cautions that arbitration cannot eliminate every enforcement risk if an award eventually reaches federal court. The Curaleaf Subsidiaries’ Response After the September ruling, the Curaleaf subsidiaries told The Marijuana Herald that they were pleased with the outcome and believed it matched the position they had maintained during the litigation. In the same statement reported September 11, they said they continued to support cannabis reform and further legalization. Their legal victory illustrates the continuing consequences of the divide between state licensing and federal authorization. A transaction can operate within a state’s cannabis framework while encountering a different answer when enforcement reaches federal court. The next question in Hello Farms’ effort is whether the appeals court agrees to reconsider its decision. For licensed growers following the case, the stakes include the ability to rely on a signed harvest contract when market prices move against the buyer. State water regulators are seeking more revenue to maintain a reduced workforce, while approximately 500 cultivation enrollments face termination in December over unpaid fees. California’s licensed cannabis growers face another potential increase in operating costs, with water regulators proposing a 28% rise in Cannabis Cultivation General Order enrollment fees for fiscal year 2027–28. The proposal comes as hundreds of existing enrollments are at risk of termination for overdue payments. Losing that coverage can also put a grower’s state cannabis cultivation license in jeopardy, making the consequences considerably greater than an outstanding bill. The figures appear in the State Water Resources Control Board’s October 6 executive director’s report and were highlighted in reporting published October 16 by The Marijuana Herald. Higher fees would maintain a reduced workforce The proposed increase would fund the program’s existing 10 regulatory positions. Although 31 fee-funded positions are authorized, revenue shortages have prevented the Water Boards from filling most of them. Annual enrollment fees support the people responsible for overseeing the program. When collections fall short, the agency has fewer resources for both enforcement and helping cultivators meet environmental requirements. The report acknowledges the instability of California’s legal cannabis market and the other regulatory costs growers already face. Those pressures have made officials reluctant to pursue larger increases in recent years. The 28% figure is a proposal for fiscal year 2027–28. The October report does not describe an immediate increase taking effect this December. December terminations pose a separate risk Approximately 4,000 Cannabis Cultivation General Order enrollments remain active, roughly 400 fewer than a year earlier. Regulators anticipate terminating around 500 additional enrollments in December because fees have gone unpaid for multiple years. Those figures count enrollments, rather than establishing that 500 separate businesses will close. The Water Boards say they contact delinquent fee payers before termination. Their report warns that losing enrollment also jeopardizes the associated Department of Cannabis Control license. For affected operators, that makes the overdue balance a licensing issue as well as a financial one. The December terminations and the proposed future fee increase are separate developments with different timelines. Why water-board enrollment matters to a cannabis farm California’s Cannabis Cultivation General Order addresses the waste discharges and environmental risks associated with growing cannabis and developing cultivation properties. Its reach extends beyond the irrigation system. The Water Boards identify potential problems including fertilizer runoff, erosion from grading and roads, pond failures, and waste generated by cultivation activities. Those issues can affect streams, groundwater and neighboring habitat even when the crop itself is being grown under a cannabis license. The state’s water-quality guidance explains that compliance with the Cannabis Policy is required to obtain a Department of Cannabis Control license. After an enrollment application is submitted and the applicable fee is paid, the Water Board issues a Notice of Applicability documenting coverage. For a commercial grower, that document forms part of the regulatory foundation of the operation. Keeping cultivation licensing records current therefore involves more than dealing with the cannabis regulator alone. Water-quality coverage and water rights serve different purposes The fee proposal concerns enrollment under the Cannabis Cultivation General Order, which regulates waste discharges. Authorization to divert and use surface water is another part of California’s cultivation rules. The Water Boards’ water-rights guidance says growers planning to divert surface water need an appropriate water right. Its Cannabis Policy prohibits surface-water diversions for cultivation during the April 1–October 31 dry-season forbearance period. Growers relying on those supplies generally need to divert water into storage during the permitted wet-season window for use later in the year, subject to the applicable conditions. The Cannabis Small Irrigation Use Registration program provides a streamlined route for qualifying small diversions and storage. Other appropriate water rights may also be available, depending on the property and project. A grower’s water source therefore matters. Municipal supplies, qualifying groundwater sources and rainwater catchment can involve different water-rights requirements, while the cultivation site’s water-quality obligations still need attention. What growers can check now For operators reviewing their records, the useful starting point is to establish which approvals cover the property and whether any correspondence remains unresolved. The Water Boards maintain an application and reporting portal for General Order enrollment, annual monitoring reports and termination requests. Their official guidance also provides separate contacts for water-quality enrollment and water-rights questions. A practical records review can bring together the Notice of Applicability, fee notices, monitoring submissions and documentation identifying the farm’s water supply. Checking those records against the actual operation can help identify questions that need to be resolved with the relevant agency. For farms named in delinquency notices, the approaching December termination process gives that review particular urgency. Three weeks before Election Day, Massachusetts voters face a proposal to dismantle the recreational cannabis system they approved a decade ago. Question 8 would preserve medical marijuana and limited possession, but end licensed adult-use sales and the legal protections for recreational home cultivation. Massachusetts could become the first state to dismantle an established, voter-approved recreational cannabis market if voters approve Question 8 on November 3. The proposal would reach across the industry, from dispensary counters and commercial cultivation facilities to the personal gardens of adults growing their own cannabis. It would repeal the laws governing the state's recreational market while keeping its medical marijuana program. Supporters say commercial legalization has created public health problems that justify closing recreational stores. Opponents argue that removing regulated sales would shift customers toward illicit suppliers, disrupt businesses and eliminate a substantial source of public revenue. For home growers, another consequence deserves attention: keeping small amounts of cannabis legal to possess would not preserve the current right to grow it. The proposal has not become law. If approved, its scheduled effective date would be January 1, 2028, giving Massachusetts more than a year between the election and the proposed repeal. Recreational home growing would lose its legal protection Massachusetts currently allows adults aged 21 and older to cultivate cannabis at their primary residence. Cannabis Control Commission guidance permits up to six plants for an individual, with a maximum of 12 where more than one adult aged 21 or older lives. The rules also require plants to be secured and kept out of public view. Landlords can restrict cultivation in rental properties. Question 8 would repeal Chapter 94G, the law that protects recreational cultivation as well as the adult-use commercial market. NORML has identified the removal of home-growing rights as a central consequence of the initiative. That matters even to consumers who seldom enter a dispensary. A personal garden provides a source of flower independent of retail prices and store availability. Removing cultivation protections would take away that option for adults relying on the recreational law. The proposal's allowance for limited possession would not authorize a recreational grow. Possession, cultivation and commercial sales have separate legal protections; retaining one would not preserve the others. Medical cultivation falls under a different framework. The survival of the medical program should therefore not be read as a promise that any existing recreational garden could continue. Possession would remain legal within narrower limits The proposed law would allow adults aged 21 and older to possess up to one ounce of marijuana, including no more than five grams in concentrate form. Adults could give cannabis to another adult within those limits without payment, provided the transfer was not publicly advertised or promoted. Possessing more than one ounce and up to two ounces would carry a $100 civil penalty and forfeiture. These provisions explain why Question 8 is more complicated than a blanket prohibition. It would retain limited possession and private gifting while removing the recreational retail and cultivation framework. The distinction also creates a practical question for consumers: being permitted to possess cannabis would no longer come with the same in-state options for buying it or growing it themselves. That question is at the center of the opponents' argument about where demand would go after repeal. Medical cannabis would continue under a separate system Massachusetts' medical program serves registered qualifying patients and their caregivers. It allows access to licensed medical marijuana treatment centers through a system based on qualifying conditions and healthcare-provider certification. That is different from recreational access, where an eligible adult can buy cannabis without enrolling as a patient. Keeping the medical program would preserve a legal route for qualifying patients, but would not automatically turn every recreational customer into a medical customer. It would also not automatically convert every existing business into a medical operator. Question 8 provides an expedited application route for adult-use licensees seeking to enter the medical program. It also allows existing recreational inventory to be sold to licensed medical treatment centers. Those provisions could help some operators make a transition. They do not guarantee that the surviving medical market would absorb the same volume of production or support every business currently serving recreational consumers. A $10 billion market faces a fundamental change The repeal proposal comes after years of growth in Massachusetts' regulated industry. In September, the Cannabis Control Commission reported that adult-use retailers had crossed $10 billion in cumulative gross sales since the first recreational stores opened in November 2018. Adult-use sales reached approximately $1.65 billion during 2025. The commission also reported about 15,000 individual employees in the adult-use industry as of August 2026, and approximately $336 million in cannabis sales, local and excise tax revenue for fiscal year 2026. The stakes extend beyond storefronts. The market includes cultivators, manufacturers, delivery businesses, transport providers and testing laboratories. For commercial growers, ending recreational retail sales would remove a major destination for their harvests. Businesses that supply those growers would also have reason to watch the transition closely. The figures illustrate the industry's scale, rather than establish a precise forecast of job losses or lost revenue. Some businesses could seek medical licenses, and the eventual effect would depend on how operators, customers and regulators respond. Supporters say commercialization has gone too far The Coalition for a Healthy Massachusetts is campaigning for a yes vote, presenting Question 8 as a response to the consequences of commercial marijuana sales. Its campaign emphasizes impaired driving, youth exposure and concerns about mental health. It argues that preserving personal possession and medical marijuana while closing recreational stores would reduce the influence of a commercial industry promoting cannabis use. Kevin Sabet, who leads the national anti-legalization organization Smart Approaches to Marijuana, has framed the initiative around the business of cannabis rather than a complete ban on possession. “Question 8 is simply about the commercialization of marijuana,” Sabet told WBUR. That framing is central to the yes campaign: adults would retain limited possession rights, but the state would no longer maintain a licensed recreational market. Whether closing that market would deliver the public health benefits supporters predict remains the disputed question. The campaign's position is an argument for repeal, rather than an established finding about what would happen afterward. Opponents argue regulation is the safer option Campaigns opposing Question 8 emphasize the safeguards attached to licensed sales, including product testing, labeling and age verification. Their argument is that cannabis demand would continue even if recreational businesses were forced to stop serving it. They say ending the regulated market would leave consumers with fewer legal options and give unlicensed sellers more room to operate. Massachusetts Cannabis Coalition executive director Ryan Dominguez told WBUR that repeal would push customers toward products without the same testing and age restrictions. He also argued that some consumers would shop outside Massachusetts, taking spending and tax revenue elsewhere. For growers and consumers, the disagreement is about how cannabis would be supplied and overseen. Supporters of repeal want to remove commercial incentives they consider harmful; opponents want to retain a regulated system and address problems within it. Neither position makes cannabis risk-free. The policy dispute concerns which system would best manage those risks while accounting for existing demand. Campaign funding reflects the national stakes The fight has drawn substantial financial support on both sides. In October reporting, GBH said the Coalition for a Healthy Massachusetts had raised more than $3 million, with the overwhelming majority supplied by SAM's fundraising arm. The same report said the Committee to Protect Cannabis Regulation had raised more than $2 million. Contributions to the opposition came primarily from cannabis retailers and manufacturers, including multistate operators. Those figures were snapshots of campaign finance activity at the time of reporting, rather than final election totals. The funding also reflects different interests in the outcome. Anti-legalization advocates see Massachusetts as an opportunity to challenge an established recreational system, while cannabis operators face a direct threat to the market their businesses serve. The measure survived challenges before reaching voters Massachusetts voters approved recreational legalization in 2016, and the first adult-use stores opened two years later. The repeal campaign began gathering signatures in 2025. Opponents subsequently challenged aspects of the initiative and the signature process, but those efforts did not keep it off the November ballot. CommonWealth Beacon reported that the Supreme Judicial Court upheld the attorney general's certification and summary in June. Signature objections also failed to prevent the measure from moving forward. Separately, a majority of the Legislature's Special Joint Committee on Initiative Petitions raised concerns about implementation, regulatory uncertainty and disruption to businesses and public safeguards. The committee's report recommended taking no action on the petition. That recommendation did not prevent voters from receiving the question; the initiative process continued. Polling favors keeping the current system September polling suggested the repeal campaign faced a difficult path. A MassINC Polling Group survey for CommonWealth Beacon found 61 percent of likely voters opposed Question 8, while 27 percent supported it. Eleven percent were undecided and one percent preferred not to answer. The survey covered 800 likely voters, with responses collected September 14–22. Its reported credibility interval was approximately four percentage points. A separate September University of New Hampshire poll, reported by WBUR, found 71 percent planned to vote against the repeal. Both polls measured preferences before Election Day. They do not establish the result, and the difference between their figures should not be treated as evidence of a trend without comparing their methods and respondents. For now, the available polling indicates stronger support for retaining the recreational system than dismantling it. November's decision would shape the next phase of legalization Question 8 arrives in a year when Massachusetts lawmakers have also pursued changes within the existing cannabis system. In April, the Legislature advanced reforms to restructure the Cannabis Control Commission, change business requirements and raise the adult possession limit from one ounce to two ounces. That approach sought to revise the regulated market rather than repeal it. November's ballot presents a much broader choice. A yes vote would approve Question 8's repeal and possession changes, scheduled for January 1, 2028. A no vote would leave marijuana law unchanged by this initiative. Until then, the current recreational framework remains in place. For Massachusetts growers, consumers and businesses, the question is whether that framework will continue into 2028 or give way to a system retaining medical access and limited possession while ending recreational sales and home cultivation. Federal officials and cannabis reform opponents have proposed a timetable for court arguments next year, while broader rescheduling faces a separate procedural hurdle at DEA. The legal fight over the Trump administration’s marijuana reclassification could continue well into 2027, after federal officials and opponents jointly proposed a timetable for the case. Their October 9 filing asks the U.S. Court of Appeals for the District of Columbia Circuit to set deadlines for written arguments extending into February. Both sides want oral arguments scheduled soon afterward, potentially before the court’s summer recess. The filing moves the litigation toward its next stage, but the proposed dates still require the court’s approval. The proposed court schedule The parties have requested the following deadlines: November 24, 2026: Challengers submit their opening brief. December 1, 2026: Supporting amicus briefs for the challengers are due. January 13, 2027: The government submits its response. January 20, 2027: Supporting amicus briefs for the government are due. February 5, 2027: Challengers submit their reply. February 12, 2027: The joint appendix of case materials is due. February 19, 2027: Final briefs are due. The proposal sets no date for a ruling. It also does not establish when DEA must finish the separate administrative process considering broader marijuana rescheduling. The legal challenge remains unresolved The litigation combines three challenges brought by marijuana reform opponents, a cannabis-focused pharmaceutical company and state officials. Those involved include Smart Approaches to Marijuana, the National Drug and Alcohol Screening Association, and MMJ International Holdings and its subsidiaries. Indiana and Nebraska also challenged the reform; Louisiana initially joined that case before withdrawing. The appeals court has already rejected an attempt to freeze rescheduling while it reviews the lawsuits. On September 9, it ruled that the parties seeking a stay had failed to meet the demanding requirements for that relief. That decision left the underlying challenges unresolved. It did not settle whether the administration’s action would survive judicial review. The court also declined to let two medical cannabis companies join the case as formal parties, finding that existing parties adequately represented their interests. It permitted them to submit amicus briefs, which allow outside parties to offer arguments for the court to consider. Medical rescheduling and broader reform follow separate tracks The dispute sits alongside a federal reform process with two distinct parts. In April, Acting Attorney General Todd Blanche issued an order placing FDA-approved marijuana products and marijuana covered by qualifying state medical licenses in Schedule III. The Justice Department linked that action to President Donald Trump’s December 2025 executive order directing officials to accelerate cannabis reform. At the same time, the administration launched a new DEA hearing to consider transferring marijuana more broadly from Schedule I to Schedule III. The distinction is important for following the case. The medical order covers specified categories, while the broader proceeding concerns marijuana’s classification beyond that limited action. A separate DEA proceeding is paused The broader administrative case has encountered its own delay. Chief Administrative Law Judge Derek Julius issued a September 29 order pausing proceedings while he considers whether a newly released Government Accountability Office report should be admitted into the hearing record. The motion came from the National Drug and Alcohol Screening Association, DUID Victim Voices and physician Kenneth Finn. They requested permission to add the report and submit further arguments about its relevance. Julius ordered the government to respond by October 13. Other participating parties may also respond by that deadline. This pause belongs to the DEA proceeding. It is separate from the appeals court’s September rejection of a request to halt rescheduling during judicial review. The watchdog report, published September 23, identified gaps in DEA and FDA policies for evaluating and scheduling substances. GAO recommended clearer procedures and an updated agreement governing consultation with the National Institute on Drug Abuse. Its findings also included an important qualification: DEA’s final scheduling decisions matched HHS recommendations for all 84 substances in the reviewed period that had reached a final rule. The agencies agreed with GAO’s recommendations. The report called for improvements to their processes; it did not itself issue a marijuana scheduling decision. Medical evidence remains central to the dispute In its August post-hearing brief, DEA argued that marijuana no longer meets the requirements for Schedule I because it has an accepted medical use and can be used safely under medical supervision. The agency relied on the Department of Health and Human Services’ scientific and medical evaluation. It also argued that marijuana’s abuse and dependence profile fits Schedule III more closely than the stricter categories. Opponents challenged both the evidence and the standards used to evaluate it. Smart Approaches to Marijuana and participating states argued that officials had departed from earlier agency practice when assessing accepted medical use. Drug-testing representatives raised concerns about workplace and transportation safety. These are arguments from the parties, rather than findings from a final ruling. In the administrative case, the judge’s role is to make a recommendation; the ultimate scheduling decision rests with the DEA administrator. Why growers and cannabis businesses are watching The stakes include how medical cultivation and distribution are regulated, along with the federal tax treatment of qualifying businesses. The April order addresses Section 280E, which prevents businesses trafficking in Schedule I or II substances from deducting many ordinary expenses. The order states that covered state medical licensees would no longer face that restriction, although it does not resolve individual businesses’ federal tax liabilities. The rule also establishes federal registration requirements for qualifying medical operators and retains controls on handling, imports and exports. For home growers, the medical order creates no nationwide permission to cultivate. Marijuana outside its covered categories remains in Schedule I, and the order does not authorize recreational cultivation or sales. The next developments to watch are the appeals court’s response to the proposed timetable and the DEA judge’s decision on whether to reopen the administrative hearing record.

A federal appeals court has trimmed the injunction that let ten hemp companies sell in Ohio outside the state's cannabis system. They now need a state license, but Ohio can't refuse one because a company is based somewhere else. A federal appeals court has cut back the order that let a group of hemp companies keep selling THC drinks and other intoxicating hemp products in Ohio without going through the state's cannabis licensing system. On Friday, September 25, the U.S. Court of Appeals for the Sixth Circuit granted part of Ohio's request to put that preliminary injunction on hold while the state appeals it. Bloomberg Law, which first reported the order, says the practical result is that the companies can no longer sell in Ohio unless they hold a license from the state's marijuana regulators. Ohio didn't get everything it asked for, though. The court also found that the geographic strings Ohio attaches to those licenses have dormant Commerce Clause problems, and it said the state can't refuse approval to a seller because of where that seller is located. A split decision The court declined to lift the injunction entirely because Ohio hadn't made a strong enough showing that it would win the case. What it did accept was the state's complaint that the district court's order reached too far, so it trimmed the order back rather than dissolving it. Friday's order only governs what happens while the appeal plays out. The appeal of the injunction itself is still pending, and whether Senate Bill 56 survives the constitutional challenge will be settled there. For the ten plaintiff companies, the road back onto Ohio shelves now runs through the Division of Cannabis Control. How Ohio got here Senate Bill 56, which Gov. Mike DeWine signed in December and which took effect March 20, rewrote Ohio's definition of hemp. Hemp now means cannabis with no more than 0.3 percent total THC on a dry-weight basis, THCA included, and any finished product with more than 0.4 milligrams of total THC per container falls outside the definition altogether. Products over that line are treated as adult-use marijuana, which in Ohio can only be sold by a dispensary licensed by the Division of Cannabis Control. Lawmakers had written in a window for regulated THC beverages through 2026, but DeWine line-item vetoed it, so drinks went into the dispensary channel with everything else. On top of that, a licensed Ohio cannabis business is generally expected to buy from and sell to other Ohio licensees, and that closed loop is what the hemp companies attacked. Ten companies led by Cleveland-based Titan Logistics Group filed suit in June against nearly 100 county and municipal prosecutors' offices. The group is a mix of Ohio businesses in Cleveland, Cincinnati and Nelsonville and outside companies from North Carolina, South Carolina, Oregon and Florida. Their argument was that SB 56 forces anyone making a federally legal hemp product to move part of their supply chain into Ohio and get licensed before they can sell there, which amounts to protecting in-state businesses from out-of-state competition. U.S. District Judge Jeffrey J. Helmick found they were likely to win on that point, granted a temporary restraining order on June 15 and turned it into a preliminary injunction on July 13. His order barred enforcement against the plaintiffs' products and against the people and businesses handling them. Helmick issued a second injunction on September 4 in a separate case, Delta Beverages v. Canepa, covering 14 more companies including Great Lakes Brewing, Rhinegeist, Fifty West, Seventh Son, Hometown Hero and Uncle Arnie's. Friday's order came in the Titan appeal, and it isn't clear yet what it means for that second group. What it means if you grow If you grow your own under Ohio's adult-use law, this order doesn't touch you. It's about who can sell intoxicating hemp products and through which door. The more useful signal is for anyone growing hemp as a crop, in Ohio or anywhere else. Ohio counts THCA toward its 0.3 percent ceiling, which puts most high-THCA "hemp" flower on the marijuana side of the line in that state. The federal definition makes the same move on December 11, when the hemp rewrite Congress passed last November takes effect after a one-month delay. The THCA flower market that grew up around the delta-9 wording of the 2018 Farm Bill is running out of road nationally, and Ohio is one of the states that got there early. The reasoning matters beyond Ohio. At least at this stage, the Sixth Circuit looks willing to let a state push intoxicating hemp into its licensed cannabis system, while drawing a line at using that system to keep out-of-state producers from competing. Illinois, for one, moves intoxicating hemp into its licensed cannabis channels on November 12 under its new Hemp Act. If this reasoning holds when the court rules on the full appeal, fights like Ohio's will turn less on whether a state can regulate intoxicating hemp and more on whether its licensing rules give outside suppliers a fair shot. For now, Ohio gets its license requirement back, and the hemp companies get a ruling that the state can't turn them away over geography, at least while the appeal runs. A Colorado marijuana manufacturer has voluntarily recalled dozens of products after laboratory testing detected methylene chloride, raising renewed questions about cannabis testing and regulatory oversight in one of America's oldest legal marijuana markets. A Colorado cannabis manufacturer has recalled 49 products after a third-party laboratory detected methylene chloride, a toxic industrial solvent prohibited in the state's regulated marijuana industry. StayCon, a Pueblo County manufacturer that operates as Craft, notified dispensaries that the affected products should be removed from sale, according to reporting by The Denver Gazette and ProPublica's Local Reporting Network. Some of the products had reportedly been available at dispensaries for more than a year. The recall includes marijuana vape products sold under names including Maui Wowie and Grape Gorilla. What Was Found? Testing identified methylene chloride, also known as dichloromethane. The chemical is used in a variety of industrial processes, but exposure has been associated with serious health risks. The U.S. Environmental Protection Agency finalized restrictions in 2024 prohibiting most consumer, commercial and industrial uses of methylene chloride after determining that exposure can cause neurological and liver effects as well as increased cancer risks. Methylene chloride is also prohibited in Colorado marijuana manufacturing. Its appearance in a regulated cannabis product therefore raises questions not only about contamination but about how the material entered the production chain. According to the recall notice described by The Denver Gazette and ProPublica, StayCon said the contamination came from a botanically derived flavoring ingredient used in its vape products. That explanation has been disputed by at least one competing cannabis company, which has alleged that the contamination could instead indicate the use of chemically converted hemp material. That allegation has not been established as the cause of the recalled products, and StayCon did not respond to questions from the news organizations about the competing claim. Why Methylene Chloride Has Become an Issue in Cannabis Methylene chloride has previously surfaced during investigations into chemically converted cannabinoids. Hemp naturally contains large quantities of CBD but relatively small amounts of THC. Chemical processes can convert CBD into intoxicating cannabinoids, creating inexpensive THC-rich material. Colorado prohibits marijuana manufacturers from using chemically converted hemp to produce products sold through the state's licensed marijuana system. Regulators and testing laboratories have raised concerns that poorly controlled conversion processes can leave unwanted solvents, reaction byproducts or other contaminants behind. Earlier investigations by The Denver Gazette and ProPublica found evidence that hemp-derived material had entered Colorado's regulated marijuana supply despite state restrictions. That makes the latest recall particularly significant. It is not simply a question of whether one batch failed a laboratory test. The incident highlights a larger challenge facing regulated cannabis markets: determining exactly where cannabinoids originated and which chemicals were used before the finished material reached a licensed manufacturer. Testing Rules Have Been Delayed The recall also arrives while Colorado regulators are working through changes to the state's cannabis testing system. Expanded testing procedures were originally expected to begin in July and would have increased screening for methylene chloride and other potentially hazardous solvents. Implementation was delayed. The laboratory that eventually detected the methylene chloride reportedly informed both the company and state regulators roughly six weeks before StayCon issued its voluntary recall. As of the September 24 report, Colorado's Marijuana Enforcement Division had not issued its own public consumer alert regarding the StayCon products. A division spokesperson told the reporters that the agency does not comment on investigations. The situation follows broader criticism of the speed with which Colorado regulators notify consumers about potentially dangerous marijuana products. A Denver Gazette and ProPublica investigation examining 23 cases where investigators could establish a complaint or investigation date found that state warnings were issued more than seven months later on average. The publications noted that this represented only a portion of the state's cases because complete investigation records were unavailable. What the Recall Means for the Cannabis Industry Colorado was one of the first states in the country to create a regulated recreational marijuana market. Because of that history, its testing and enforcement system has often been treated as a model for newer cannabis programs. The current controversy demonstrates that mature markets can still struggle with rapidly changing extraction technologies, cannabinoid conversion and increasingly complicated supply chains. Traditional potency testing alone cannot necessarily determine how a product was manufactured. That puts greater importance on expanded contaminant testing, ingredient documentation and supply-chain verification. For licensed manufacturers, the case also shows the potential consequences of relying on ingredients or cannabinoid inputs without fully understanding how those materials were produced. For regulators, it raises a different question: how quickly should potentially contaminated products be removed from shelves once a credible laboratory result appears? And for the wider cannabis market, the recall reinforces an issue that has become increasingly important as marijuana and hemp supply chains overlap. A product being sold through a licensed dispensary does not eliminate the need for robust testing. As cannabis products become more processed and chemically complex, regulators and laboratories are increasingly being asked to detect contaminants that were rarely part of traditional cannabis testing programs. Colorado's latest recall suggests that those testing standards may need to evolve just as quickly as the products themselves.

Large hemp operators planning layoffs or closures may have an important employment-law deadline approaching as sweeping changes to the federal definition of hemp move closer to taking effect. The U.S. hemp industry is preparing for a major regulatory shift on December 11, 2026, but some companies could face another deadline nearly two months earlier. According to reporting from MJBizDaily, hemp businesses that expect the new federal rules to force major layoffs or facility closures may need to notify workers by October 12 in order to comply with the federal Worker Adjustment and Retraining Notification Act, commonly known as the WARN Act. The issue adds another layer of uncertainty for an industry already trying to determine which products can remain on the market once the new federal hemp definition takes effect. Federal Hemp Rules Change December 11 The new federal framework significantly tightens the definition of legal hemp products. Under the upcoming rules, finished products containing more than 0.4 milligrams of total THC per container will fall outside the federal definition of hemp. Products that no longer qualify as hemp could instead be treated as marijuana under federal controlled-substance law. That threshold is dramatically lower than the amount of THC currently found in many hemp-derived products, including beverages, gummies and other products containing delta-8 THC, delta-9 THC or related cannabinoids. The change therefore has implications well beyond high-potency hemp products. Many products currently marketed as legal hemp could require reformulation, removal from interstate commerce or an entirely different regulatory pathway. Businesses have spent much of 2026 evaluating inventory, reformulating products and considering whether parts of their operations can survive under the new standard. For larger employers, however, workforce planning could now become just as important as product compliance. Why October 12 Matters The federal WARN Act generally requires qualifying employers to give workers 60 days' written notice before certain mass layoffs or plant closures. That requirement does not apply to every business or every round of layoffs. Factors including company size, the number of employees affected and the percentage of workers losing their jobs can determine whether WARN applies. MJBizDaily reported that larger hemp operators with more than 100 employees could face WARN obligations if planned layoffs or closures meet the law's thresholds. Because the federal hemp changes are scheduled for December 11, companies that already know they will close facilities or conduct qualifying layoffs could need to issue notices around October 12. Missing the requirement can become expensive. Employers found in violation can potentially face liability for lost wages and benefits covering the notice period, while affected workers may be able to pursue claims individually, through unions or as part of class-action litigation. State employment laws can impose additional requirements. The precise obligations will depend on each company's circumstances, meaning operators facing significant restructuring will likely need specialized employment-law guidance rather than assuming the federal rule applies uniformly. Hemp Companies Are Preparing for Major Changes The hemp-derived cannabinoid industry expanded rapidly after the 2018 Farm Bill established a federal distinction between hemp and marijuana. That framework allowed businesses to produce a wide range of cannabinoid products derived from federally legal hemp. Over time, intoxicating products containing hemp-derived delta-8 THC, delta-9 THC and other cannabinoids appeared in convenience stores, liquor stores, smoke shops and online retailers across much of the country. The coming federal changes substantially narrow that marketplace. Some companies are attempting to develop products that comply with the new THC limit. Others are moving toward state-regulated cannabis markets or focusing on non-intoxicating products. Companies holding large quantities of products that will no longer qualify as hemp are also under pressure to manage inventory before the December deadline. Employment decisions are therefore becoming part of the same transition. Industry employment data cited by MJBizDaily estimates that roughly 225,000 people currently work within the hemp sector, although it remains unclear how many positions could ultimately be affected by the new federal rules. Another Complication for an Industry in Transition The approaching deadlines illustrate how the federal hemp changes extend beyond the products sitting on store shelves. Manufacturers must consider formulation and testing. Distributors must consider whether products can legally cross state lines. Retailers must decide which inventory they can continue selling. And larger companies may now have to make employment decisions months before they know exactly how the post-December hemp market will develop. Congress could still modify the law before the new definition takes effect, but businesses cannot necessarily assume that will happen. For companies already expecting closures or significant workforce reductions, waiting until December to make those decisions could create additional legal exposure. The result is an unusual situation in which hemp operators are effectively working against two clocks: an employment deadline in October and the federal product deadline in December. For the broader cannabis industry, the transition will be closely watched. Hemp-derived THC has grown into a major competitor to state-licensed marijuana businesses, particularly because hemp products have often been able to reach consumers through ordinary retail and interstate commerce. The December rules could significantly redraw that boundary. Whatever happens next, the final months of 2026 are shaping up to be one of the most consequential periods for the U.S. hemp industry since the passage of the 2018 Farm Bill.

A federal watchdog says the agencies need clearer written rules for evaluating controlled substances. Its findings do not decide the pending proposal to move marijuana to Schedule III. The U.S. Government Accountability Office (GAO) says the Drug Enforcement Administration and Food and Drug Administration lack comprehensive written procedures for parts of the federal drug scheduling process. The findings arrive while a broader proposal to move marijuana from Schedule I to Schedule III remains under review. In its September 23 report, GAO examined DEA scheduling actions involving 208 substances from 2020 through 2025. DEA considered recommendations from the Department of Health and Human Services (HHS) in all 95 cases where it was required to do so. By the end of 2025, DEA had issued final rules for 84 of those substances, and every decision matched HHS’s recommendation. The remaining 11 were under extended temporary scheduling orders. That record does not mean GAO gave the agencies a clean bill of health. Investigators found that DEA lacks policies spelling out staff roles, responsibilities and procedures for major scheduling tasks. FDA has policies covering some aspects of the process, but no comprehensive written instructions for how its staff should carry out evaluations and develop recommendations. GAO specifically called for FDA to clarify how it assesses a substance’s potential for abuse relative to other drugs. GAO also found that an agreement governing how FDA consults the National Institute on Drug Abuse is more than 40 years old and no longer reflects the offices and procedures in use today. GAO recommended that DEA and FDA establish the missing procedures and that FDA and the National Institutes of Health update the agreement. The agencies agreed with the recommendations. What this means for marijuana HHS supports moving marijuana to Schedule III. DEA held a hearing on the broader rescheduling proposal in June and July 2026. A separate, narrower final rule has already placed certain FDA-approved marijuana products and products covered by state medical marijuana licenses in Schedule III; the wider proposal is a distinct proceeding. GAO’s review does not find that DEA mishandled the marijuana case, invalidate the hearing, or set a deadline for a final decision. The 84-to-84 figure concerns past decisions across different substances; it is not a forecast for marijuana. For growers and patients following federal reform, the immediate takeaway is about process: the watchdog wants the agencies to put their evaluation methods and responsibilities in writing while the larger marijuana decision remains pending.
